MOTION FOR EARLY RESOLUTION

PETITIONERS LANDOWNERS AND REALLOCTEES, by counsel,

respectfully state:

1. Under date of 23 December 2012, petitioners have filed their Appeal

Memorandum, pursuant to the directive of the Honorable Office.

2. It has been almost four (4) months since petitioners filed their

appeal Memorandum, pursuant to the directive of the Honorable

Office.

3. We understand the multifarious quasi-judicial chores the Honorable

Office is presently saddled with. However, petitioners respectfully

pray that should the precious time of the Honorable office permit it,

the instant appeal be resolved soon.

4. In the meantime, respondents have been introducing improvements

and structures unto the land, with total disregard of the fragile eco-

1
system of Barangay Maisog as a watershed. It is feared that unless a

CEASE AND DESIST ORDER shall have been issued by the

Honorable Office, enjoining respondents, MARO, PARO and the

Registry of Deeds from further implementing the unlawfull selection

of respondents as beneficiaries, petitioners will suffer grave nd

irreparable injury, as respondents’ wanton use of the land illegally

awarded to them shall cause severe damage to the fragile eco-system

of Barangay Maisog. Worse, these clueless respondents will be using

their hard-erned money to build structures and improvements on

the land illegally awarded to them, only to be deprived thereof later,

should the Honorable Office nullify their selection s beneficiaries.

5. Accordingly, it is respectfully prayed tht CEAASE AND DESIST

ORDER be issued, enjoining the MARO, PARO and the Registry of

Deeds of Camarines Norte, from further implementing the selection

of respondents as agrarian reform beneficiaries, and from further

issuing any CLOAs and/or transfer certificate of titles in favor of

respondents.

WHEREFORE, forgoing premises considered, it is most

respectfully prayed of this Honorable Court that the instant
motion be resolved in the soonest possible time.
