ARTICLE I – TITLE, STATEMNT OF POLICY, AND DEFINITION OF TERMS

This article contains the title, statement of policy, and definition of terms. The title introduces the Act
that is known as the –Philippine Mechanical Engineering Act of 1998. The statement of policy states the
importance of mechanical engineers in a nation and how they are highly recognized because of their
talents and other positive qualities that contributes to the development and building of a nation.
Another section of this article includes the various practices and services on how a mechanical
engineering is deemed by. Also, brief definition of mechanical equipments or machinery, mechanical
processes, and capacity of process works, projects or plants are given.

Article II – BOARD OF MECHANICAL ENGINEERING

This article contains all details about the board of mechanical engineering. Starting from what is the
composition of the board of mechanical engineering and how it is created. This article also states the
qualifications or requirements that a member of the board should possess. It is stated on how long is the
term of office of a member of the board and other specific rules that affect their term of office. This
article also contains the compensation and allowances of the board. Also, the board is always under the
general supervision of the Commission and only the secretary of the board has the power to handle all
their records. This article also includes the various power as well as duties of the board. The board is
also required to give an annual report about their accomplishments to the President of the Philippines
through the Professional Regulation Commission. Lastly, it is stated in this article the removal of a board
member on how it is done and why a member of the board is being removed.

Article III – EXAMINATION, RGISTRATION, AND LICENSE

This article consists of 21 sections starting from a section that states that all applicants of mechanical
engineer profession shall undergo a written examination. The practice of mechanical engineering is
ranked into three categories: Certified Plant Mechanic, Mechanical Engineer, and Professional
Mechanical Engineer. Qualifications required are also stated for each aspiring mechanical engineer and
certified plant mechanic applicants. Also, the requirement on how a mechanical engineer can be granted
the ranking of professional mechanical engineer is given. An applicant of mechanical engineer should
pass a written examination on three different subjects that is stated in this article. The examination of
an applicant for certified plant mechanic may be written or oral. To pass the examination, a candidate
for PME, RME, and CPM must obtain an average of 70% on all subjects with no rating below 50% in any
of the subjects. The Board will submit the ratings of the candidates to the Commission. All successful
candidates are required to take an oath. A professional license bearing specific details will be issued to
every registrant. All persons whose names now appear in the roll of PME, RME, CPM under the custody
of the Board and the Commission shall become members of th integrated and accredited organization of
mechanical engineers. A PME shall receive a seal of such design prescribed by the Board. The Board has
the power to suspend or revoke any certificate of registration and to revoke or suspend the license of
mechanical engineers. All practicing Mechanical Engineers who are registered at the time this Act takes
effect shall automatically be registered. There are also coverage of temporary/special permits for the
approval by the Commission.

ARTICLE IV – PRACTICE OF THE PROFESSION

The first section in this article states the responsibilities of a mechanical engineer either he is in charge
of the preparation of plans, designs, specifications or he chooses to teach professional subjects unless
he is duly licensed professionally or he is to be in responsible charge of construction installation,
alteration or of the performance of a mechanical engineering service in connection with manufacturing,
etc. There are also assigned capacities where there is a limit of how much plant capacity you can
operate based on your ranking. There is also the requirement of number of personnel in each plant
depending on its capacity. All works, processes, and plans of a construction shall be under the
supervision of a professional mechanical engineer and shall be duly signed by one. There are certain
rules on posting certificates of a registered engineer. Names of registered mechanical engineers are
prepared by the Commission and are available if requested by an interested party. Foreign mechanical
engineers shall not be allowed to be given a certificate of registration or be entitled to any privileges
under this act

ARTICLE V – PENAL AND CONCLUDING PROVISIONS

Any person who violates any of the provisions of this Act and its rules and regulations shall, upon
conviction be penalized by a fine depending on the degree of the violation. The Board is responsible for
the formulation and implementation of rules and regulations to carry out the provisions of this Act.
Separability Clause is applied in this act where if one section is voided then the remainder will not be
affected. There is a also a consequence for the inconsistent practice of mechanical engineering. Also,
rules are stated for faculty members teaching professional mechanical engineering subjects for the
validity of continuing to teach. The present Board will continue to be in service until a new Board would
be constituted.
