Introduction
A huge scheme of KhpalKor low cost affordable housing has been launched with the help of
Bank Home Financing facility, benefiting a large number of government servants and
general public. In the first phase the facility has been extended to the existing allottees
(Provincial Government Servants only) of Jalozai Housing Scheme, Mulazai Housing
Scheme Peshawar, Havellian Township Abbotabad and Jerma Housing Scheme Kohat. In
the second phase the scheme will be extended to the government servants who will be
allotted the balance plots in the said housing schemes, through computerized draw. In third
phase low cost affordable build up houses and apartments will be provided to government
servants (initially in the KhpalKor Scheme-I at DheriZardad on main motorway near
Charsadda Interchange under PPP. In the 4th phase build up apartments will be provided to
government servants in different cities under PPP.

The initiative will provide planned affordable housing, stabilize the soaring real estate
prices and generate huge economic activity in the province. Under the scheme the banks
will provide home finance facility under a tripartite agreement between Banks-Employees-
Government/PHA. The Construction will be undertaken by allottees themselves and
completed in one year. A 5 Marla single storey house having 2 bed rooms, DD, Porch,
Kitchen, two baths, backyard will cost about Rs. 18 lacs including cost of land and
development.

The prospective return from the house will be sufficient to pay back the installments rather
would fetch some saving as well besides increase in the value of the house . Regional
Facilitation Centers have been established at Peshawar, Swat, Abbotabad and Kohat for
free facilitation of the aspiring government servants as well as general public, in
preparation of the documentation for the bank home finance facility.

Arrangements (optional) for low cost affordable construction material/preferably


technology are being negotiated with Chines & Local companies.

Eligibility Criteria
1) In the subject Scheme titled “KhpalKor (2K) Low Cost Housing Scheme”, the Client
must be a Regular Employee of the Provincial Government of Khyber Pakhtunkhwa
or State owned autonomous entities of the Government of Khyber Pakhtukhwa
with minimum 2 years of verifiable service history
2) Age at the time of applying for facility must be 25 to 55 years. However, Home
Finance maturity (expiry) will not be extended beyond superannuation of the Clients
(i.e. 60 years of age of the Clients).
3) The Average monthly verifiable Gross Income shall be Three (3) times of the
proposed monthly installment; with minimum Gross Monthly Salary of PKR
50,000/-. A Client can also add other verifiable monthly income to supplement the
verifiable Gross Income for consideration of Home Finance.
4) The proposed Home Finance installment plus other finance facilities installments (if
any) be less than 50% of the take home salary / income.
5) The Client(s) shall not be Home Finance Defaulter(s) in any of the scheduled Bank(s)
and should not be party to a litigation against any Bank, in particular the Bank of
Khyber. A Certificate to this effect shall be provided by the Clients at the time of
submission of application.
6) Have no other residential plot in his/her name /dependents in any scheme under
PHA

Lower and Upper Ceilings of KhpalKor (2k) Home Finance


1) The amount depends on the requirement of every applicant and would be uptoRs.
18 lacs for Marlas, Rs: 2.5 million, 3 million for 10 marlas and 4 million for 1 kanal.
2) The maximum amount of Home Finance approved by the Bank of Khyber, albeit
non- negotiable, would be PKR 4.0 million. This would be subject to age and income
of the employee and other considerations as detailed in this Tripartite Agreement.
3) The Debt to Equity Ratio would be 80:20 and is non-negotiable.
4) The Home Finance shall be released as per plan agreed with the Client.

Period of Finance
The Home Finance would be provided to the eligible Clients for a period not exceeding 20
years from the date of crediting of amount into the Client's Bank account or the remaining
service period, whichever is less. However, construction must be completed within 12
(twelve) months of crediting of Home Finance into the Client's account and a certificate to
this effect shall be furnished within one month after the said completion.

Mark Up Rate
The predetermined non-negotiable Markup Rate shall be 1 (One) year KIBOR plus 1% or 2%
for a year, depending on the choice of bank at the time of signing of the Tripartite
Agreement for BHF.

Home Finance Repayment
A Repayment Installment shall be due on the 1st of each month or receipt of monthly salary
in Client's account (whichever is earlier) which is to be maintained with any of the branches
of The Bank of Khyber across Pakistan. The account will not be shifted from The Bank of
Khyber until complete retirement of the Home Finance.

Insurance
The Client agrees to pay The Property (Building) Insurance from an “A” Rated Insurance
company with a maximum premium rate of 0.2% plus taxes as well as an “Accidental Death
Life Insurance” with a maximum premium rate of 0.3% plus taxes.

Payment of Salary Through Bank of Khyber


The District Accounts Office will transfer the salary of the Client to the account of the Client
maintained with a designated branch of The Bank of Khyber.

Late Payment
Late Payment Fee is not applicable against payment of Home Finance Installment.
However, the Client hereby authorizes The Bank to deduct installment from his/her Bank
Account in case the monthly salary is not received in the Bank, for any reason, up to the
15th of each month.

Processing Fee
The Bank of Khyber will charge Rs. 1500 plus Federal Excise Duty as processing fee payable
by the Client.

Calculation of Monthly Installment and Amortization


1) The Amortization Table and calculated monthly installment for all purposes be
considered a part of this Tripartite Agreement and the Client agrees to and abide by
the Amortization structure and Monthly Installment Plan relevant to the approved
Home Finance.
2) Stamp duty and other charges payable for Deed of Mortgage or charge shall be paid
by the Client.

Securities Against House Finance
1) The Client's salary account shall be maintained with The Bank of Khyber and the
salary shall not be transferred to any other bank without NOC from BOK, on any
grounds whatsoever, till adjustment of the subject Home Finance.
2) The Client execute an Equitable mortgage by depositing original allotment letter
issued by the Provincial Housing Authority with The Bank till repayment of any
outstanding amount of Home Finance and interest payable on account thereof .
3) The Bank's lien on property shall be duly marked with relevant authority which in
this case is the Provincial Housing Authority/Housing Department, Government of
Khyber Pakhtunkhwa.
4) The Client shall provide Personal Guarantees for themselves as well as for co-
Clients(s) as per requirement of The Bank of Khyber.
5) The Client shall provide a List of Documents which shall form part of this Tripartite
6) Agreement (Attached as Annex to the Tripartite Agreement)
7) In case of default in execution of the mortgage in favor of the bank to secure the
Home Finance or in default in repayment of installments and/or interest thereof, the
bank may exercise its power under the Power of Attorney executed by the Client in
favor of the Bank and to take all actions under the said Power of Attorney including
completion of conveyance deed, taking possession of the title deeds and/or
possession of the allotted plot.

Regulation
1) The Regulator/GoKP-PHA shall ensure that the Client shall abide by the terms of
this agreement and will not shift his/her salary to any other bank or other means,
save with other branch of The Bank of Khyber, without NOC from the Regulator and
shall take disciplinary action in case of such violation, against the Client under
Efficiency & Discipline Rules 2011.
2) Applications for Bank Home Finance shall be routed through the Regulator through
the Office of Director General Provincial Housing Authority.
3) The Regulator shall endorse the agreement through DG Provincial Housing
Authority.
4) The Regulator shall provide a copy of this agreement to the Controlling Officer and
Drawing & Disbursing Officer of the Client to take effect in the transfer of the salary
of the Client to The Bank of Khyber and ensure that the salary is not transferred to
any other bank other than The Bank of Khyber.
5) The Regulator shall establish Regional Facilitation Centers for helping the Clients in
preparation of the required documents for the Client.
6) The Regulator shall coordinate with the First &Third Party and shall ensure that the
interests of both the parties are protected/safeguarded under the provision of this
agreement and no party violates the contractual obligations.
7) The Regulator will coordinate with the Bank and shall maintain record of the Home
Finance granted, repaid and outstanding, through online link with the Bank.

Procedure for Submission of Application Forms
The forms may be submitted to the following Banksmentioned against each housing scheme
1. Havellian Township and Mulazai Housing Schemeforms may be submitted in MCB Bank2. Jaloza
Hosing Scheme andJerma Housing Scheme forms may be submitted in Bank of Khyber

a) Submission of application
1. Applicants are advised to submit their applications, duly filled in, on the
prescribed application form (Annexed/available on website of PHA) upto the
date to be notified in the Newspapers, in the designated branches of theMCB
andBank of Khyber, As mentioned above.
2. Applications must be accompanied with the down-payment.
3. Rs. 500 as processing fee (non-Refundable) for all categories of plots.
4. The completed applications will be submitted in person/ through bearer in the
designated branches of The Bank of Khyber
5. This payment receipt must be kept in safe custody till receipt of allotment order
or refund of advance money in case of unsuccessful applicants.

b) Detail of required documents to be attached with application form.


i. Original application form (Annex-A) duly signed / filled in / complete in all
respect with photograph size (3.5 x 3.5 cm).
ii. Advance Deposit slip duly filled.
iii. Attested copy of CNIC.
iv. A certificate from the Department that the applicant is a regular employee of
the Provincial
v. Government of Khyber Pakhtunkhwa.

c) Refund of unsuccessful applicants.


i. Refund of advance to unsuccessful applicant will be made after the balloting
process is completed but not later than two months. The refund will be obtained
from the same branch of the BoK where the application was submitted, on the
surrender of original application receipt. The applicant can authorize his/her
representative to collect the refund pay slip in the name of original applicant on
the provision of the following.
ii. Letter of Authority duly signed by the applicant, as per his/her specimen
signatures given of the original application.
iii. Attested copy of CNIC of applicant.
iv. Attested photocopy and original CNIC of the representative.
v. Original receipt duly signed by the applicant on its reverse as per signature on
the application form.
vi. The refund pay slip duly crossed as “payees account only” and marked as “not
transferrable” will be issued to the unsuccessful applicants by the locally
designated branches of Bank within 30 days from the date announced by PHA
for start of refund.
vii. Applicants will have to indicate in the application form the name of one nominee
(not a minor) alongwith his/her relationship with the applicant mentioning
National Identity Card No to whom the refund is to be made in case of death of
an unsuccessful applicants.

d) Applications with the following deficiencies are Liable to be Rejected
i. Any over-writing in the category/plot size columns or circling of more than one
category/ plot size.
ii. Leaving any of the details un-filled in the application form. c) Absence of
signatures of the applicants.
iii. Applications without required documents.

e) Mode of Payment
i. The cost of plot will be recovered from the bank home finance and shall be
deducted at source under an agreement between Bank-employee-Provincial
Housing Authority in the following manner.
a) Advance Payment as above
b) 20% from first installment of Bank Home Finance
c) 30% from Second installment of Bank Home Finance d) Balance from
third instalment of Bank Home Finance.
ii. The applicant can pay the cost of plot from his own saving in three instalments
as above if he/she does not want to avail the BHF facility.

f) Miscellaneous
i. The allotment shall be done by balloting through computer in a transparent
manner.
ii. The actual amount of price payable by the allottee will be adjusted on actual
measurement of the plot by the Authority at the time of handing over the
possession of the plot.
iii. Construction will be executed by allottees themselves
iv. The construction shall be completed in one year or as agreed with Bank.
v. The house will be constructed according to the designs to be provided by PHA
free of cost.
vi. The plot shall not be divided in to two parts, however amalgamation of the plot
shall be allowed with prior permission of the PHA.
vii. The allottee can contribute the cost of construction from his/ her own savings.
viii. The allottee can obtain partial or full amount of BHF from bank.
ix. Provision will be made in the design and structure for vertical construction in
future (at least ground plus two storeys).
x. If for any reason the allottee surrenders the plot to the authority 20% of the
deposited amount of the plot shall be forfeited and the balance amount will be
refunded.
xi. In case allotment of plot is obtained by giving false information/affidavit, the
allotment will be cancelled and 30% of price of plot shall be forfeited, whenever
the factual is brought in the notice of PHA .
xii. On completion of the construction of the house on the plot and fulfillment of the
terms and conditions contained in the Sale Agreement, the Authority on the

request of the allottee will execute conveyance deed in his/ her favour at his/her
cost and expense.
xiii. Intimation shall be given to the Authority in case of devolution of interest in the
plot by inheritance or operation of law.
xiv. The allottee shall be liable to pay from the date he takes over possession of the
plot all the assessment, duties charges (including betterment and maintenance
charges) and imposition which may now or hereinafter be charged or imposed
upon or be payable in respect of the said plot or anything related thereto by any
competent authority (including the PHA) under any law, rules, regulations, by-
law or order for the time being in force.
xv. Any officer of the PHA authorized in this behalf shall have the right to enter
upon the plot or building there upon at all reasonable hours of the day in case of
any complaints/violations.
xvi. The allottee shall comply with and abide by the rules regulations, bye-laws,
orders or directions that may be issued from time to time by the PHA or any
other concern Authority.
xvii. The PHA reserves to itself the right to cancel the allotment of any plot, resume
its possession and forfeit 10% of the deposited amount in case of contravention
of any condition of allotment and may also take possession of the building
constructed on the plot or any material found there without any compensation if
not removed within a given time.
xviii. Ifan applicant, his/her spouse or dependent child/children are declared
successful for more than one plot ONLY ONE PLOT WOULD BE ALLOTTED.
xix. The allotted plots and houses would be transferrable after 100% payment to
PHA dues subject to payment of transfer fee and fulfillment of other terms and
conditions as may be prescribed by the authority from time to time.
