WHEREAS, Section 11, Article II of the 1987 Philippine Constitution provides that
the State values the dignity of every human person and guarantees full respect for
human rights.

WHEREAS, Section 18, Article II of the Constitution further provides that the State
affirms labor as a primary economic force and shall protect the rights of workers and
promote their welfare.

WHEREAS, the Philippine Congress enacted on February 14, 1995, Republic Act
No. 7877 (RA 7977), otherwise known as the “Anti-Sexual Harassment Act of 1995”,
which took effect on March 5, 1995 and declares unlawful sexual harassment against
women and men in the employment, education and training environment.

WHEREAS, Section 4 (a) of RA 7877 enjoins every employer or head of the agency
in the public and private sectors to promulgate rules and regulations prescribing the
procedure for the investigation of sexual harassment cases and the administrative
sanctions therefor;

WHEREAS, Section 4 (b) of RA 7877 likewise directs every employer or head of the
agency to create a committee on decorum and investigation tasked to investigate,
resolve, and impose necessary disciplinary actions involving sexual harassment cases;

WHEREAS, Civil Service Commission (CSC) Resolution No. 01-0940 dated May 21,
2001, entitled May 21, 2001, entitled “Administrative Disciplinary Rules on Sexual
Harassment Cases”, defines the administrative offense of sexual harassment and
prescribes the standard procedure for the administrative investigation and resolution of
sexual harassment cases in the public sector;

WHEREAS, the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) is


committed to have a safe working environment that is free form sexual harassment and
uphold the dignity of its workers;

WHEREAS, TIEZA assumes the responsibility to prevent and undertake immediate


corrective measures in the Investigation, Resolution, Settlement, and Prosecution of
sexual harassment cases within its legal authority;

WHEREAS, pursuant to RA 7977 and Section 7 of CSC Resolution No. 01-940, the
Tourism Infrastructure and Enterprise Zone Authority Committee on Decorum and
Investigation of Sexual Harassment Cases (TIEZA-CODISH) was thereby created;
NOW, THEREFORE, the TIEZA hereby promulgates the following Rules and
Procedure defining the administrative offense of Sexual Harassment and prescribe
standard procedure in the Investigation, Resolution, Settlement, and Prosecution of
Sexual Harassment Cases within TIEZA.
