Section 1.

Title- This act shall be known as “


Section 2. Coverage- This act shall cover employees such as but limited to: a. Gymnasts b.
Acrobats c. Circus or show performers d. Trapeze artist e. Amusement rides operators f. Game of
chance operators
Section 3. Definition of terms
Gymnasts - person who performs various physical exercises on a mat or on special
equipment as part of an athletic competition: a person who participates in the sport of gymnastics
Acrobats - a person who entertains people by carrying out difficult and skillful actions,
such as walking in the wires. Circus or show performers - persons who perform in circus or
shows of similar nature
Trapeze artist - performer or acrobat who walks along a free-swinging bar attached to
two ropes
Amusement rides operators - one charged with the safe operation of rides at amusement
parks, fairs and festivals.
Game of chance operators - one charged with the operation of game of chance which is
a game whose outcome is strongly influenced by some randomizing device, and upon which
contestants may choose to wager money or anything of monetary value.
Period - shall start before the fiesta or festival and end after the fiesta or festival

Employment Terms and Conditions


Section 4. Regular Employment- the herein employees shall be regarded as regular employees
provided that they render performance or services for three (3) consecutive periods and undergo
training and passed the evaluation of the employer.
Section 5. Employment of Minor- In case that the employer hires a minor, both parents of the
minor shall give consent. The time of work shall only be 4 hours a day and shall not be longer
until 10 pm. The employment of the minor shall be 3 days in a week which shall not be
consecutive.
Section 6. Benefits- the employees shall be covered by Social Security System (SSS), the
Philippine Health Insurance Corporation (PhilHealth), and the Home Development Mutual Fund
or Pag-IBIG Fund in accordance with the provisions of the Labor Code of the Philippines.
Section 7. Health – The employer shall provide a system or mechanism that includes as follows:
a. medical team for the protection and assistance of the employees before, during, and
after every performance for on-site emergency care.
b. medical plan for the employees, such as individual and group strength and
conditioning programs, rehabilitative and injury prevention therapy, exercise therapy,
nutritional support, emergency medical planning and care, and dental care.
c. an insurance that will cover any injury or sickness obtained by the employee in the
course of the employment.
d. nutritional support, especially to minor and women performers
Section 8. Rest and Leave Benefit- The employee shall be entitled for a minimum two (2) days
rest day every week and ten (10) days leave every unless the employer provides for additional
rest and leave.
Section 9. Board, Lodging and Meal Allowance – The employer shall provide for the basic
necessities of the employees to include at least (1) adequate meal a day and humane sleeping
arrangements that ensure safety.
Section 10. Termination- The employer or employees shall not terminate the contract of
employment except for the grounds provided by the Labor Code of the Philippines. If the
employee is dismissed based on justifiable ground, he shall be paid separation pay equivalent to
at least one (1) month salary or to one-half (1/2) month salary for every year of service,
whichever is greater. If the employee is unjustly dismissed, he shall be entitled to reinstatement
and full back wages. A separation pay may be granted if reinstatement is not possible.
SEC. 11. Separability Clause-If any part or provision of this Act is held invalid or
unconstitutional, other provisions not affected thereby shall remain in force and effect.
SEC. 12. Repealing Clause-All other laws, decrees, orders, issuances, rules and regulations
which are inconsistent with the provisions of this Act are hereby repealed, amended or modified
accordingly.
SEC. 13. Effectivity-This Act shall take effect fifteen (15) days after its publication in at least
two (2) newspapers of general circulation.
