City OF CLEARLAKE CITY COUNCIL STAFF REPORT (MEETING OF: March 14, 2019 Faenda Rem No [3 Subject Consideration of Employment Services Date: March6, 2019 ‘Agreement with lan Floraas City Manager Reviewed & Approved: From: Ryan R, Jones, City Attorney Recommended Action: Motion to approve Employment Services Agreement for City Manager with Alan Flora Coenen ee ISSUE STATEMENT AND DISCUSSION city Manager, Greg Folsom, has informed the City Council that he willbe resigning as City ‘Manager effective March 30, 2019, in order to take a postion with another public entity. As @ replacement option forthe City Manager postion, the Council is considering whether to hire ‘Assistant City Manager and Finance Director Alan Flora to serve as the next City Manager for the City of Clearlake. If the Council chooses Mr. Fora as Its next ity Manager, the attached Employment Services [Agreement is proposed. The key components ofthe Agreement are the following: ‘The Agreement is fra term of 3 years, with an option fortwo additional years if agreed to by both parties. Mr, Flora would start with a monthly salary of $12,808.33. There is ‘also a combined car and cell phone allowance of $400 per month. The other provisions ‘of the Agreement generally follow the terms provided in Mr. Folsom’s City Manager agreement. Pursuant to subsection (3} to Government Code § 54953), prior to the City Council taking final action, staff will provide ar oral report summarizing the financial highlights of the proposed ‘Agreement. FINANCIAL IMPLICATI “The Agreement would be a net savings annually to the City’s general fund in that Mr. Flora's financial compensation is less than the outgoing City Manager. In adltion, there will be some Additional short-term savings white Mr Flora serves ay both the Finance Director and City Manager. ‘Attachment; Proposed Employment Services Agreement with Mr. Flora CITY OF CLEARLAKE [EMPLOYMENT SERVICES AGREEMENT (WITH ALAN FLORA, CITY MANAGER 1, PARTIES AND DATE. ‘This Employment Services Agreement (hereinafter referred to asthe “Agreement made and entered into this March 14, 2019 ("Effective Date") by and between the City of Clearlake, @ California municipal corporation (hereinafter referred to as “City") and Alan D. Flora (hereinafter refered to as "Employee"). City and Employee are sometimes individually referred to herein as "Party" and collectively as “Parties” 2, RECITALS. City desires to employ the services of Employee as City Manager forthe City of Clearlake and Employee desires to accept employment as City Manager. It is the desire of the Parties through this Agreement 1o provide for certain benefits, establish conditions of employment and to set working conditions for Employee. Employee currently serves the City as the Assistance City Manager and Finance Director ‘and has an agreement, dated July 1, 2018, with the Cty reflecting that employment relationship. Upon execution ofthis Agreement, the Employee's agreement, dated July 1, 2018, is terminated immediately and replaced with this Agreement. 3. TERMS. 3a Duties. 3.1.1Designated Duties. City hereby agrees to employ Employee as City ‘Manager to perform the functions and duties pertaining to the City Manager position, and to perform other legally permissible duties and uct funetions asthe City Counel shal rom time ta time assign. The City CCotncil shall have the authority to determine the specific duties and functions that Employee shall perform under the Agreement and the means and manner by which Employee shall perform those duties and functions.
