18th Amendment in Constitution of Pakistan

Background 18th Amendment in Pakistan:


During Pervaiz Musharraf era, enhance power of president. That 17th
amendment in Constitution of Pakistan enhance power to president and
governors. Afterward On 8th April 2010, 18th amendment passed by People Party
to counter the power of president to enhance federalism and parliamentary
structure of the constitutions, for political instability. That make autonomy power
to Federated Units (Sub State or Provinces).

Major Impact or Changing in Constitution of Pakistan:


 17th amendment and Legal Framework repealed from Constitution.
 The Council of Common Interest (CCI) has been reconstituted with Prime
Ministry as its Chairman.
 The amendment turns President into ceremonial head of state, and transfer
major power to Prime Minister.
 Gave Autonomy Power to Federated State.
 Recognition of children’s right to education and it is state duty to give
Pakistani children’s free education up to age of 16.
That all amendments enhance federalism in Pakistan and After that, Pakistan
become more federated sovereign state than past Pakistan.
By that amendment prime ministry become representative of their sovereign
state in foreign affairs and enhance Pakistan provinces autonomy power.

Federalism:
Federalism means system of government in which sovereign or national
state gives autonomy power to sub-state or provinces to makes rules and
regulation which make betterment for their federated unit. By federalism it is
decentralized of power between different provinces.
Federated Units: Decentralized authority, and National Sub State which has
power of province of to apply their policies in their province.
Federalism enhance by 18th Amendment:
Federated units have power to apply their rules and regulation which is
better for their units and also has autonomy power to units that is, Chief Ministry
of Pakistan make projects of electricity, educations, food, agriculture and health
etc. in their domain. By that federated unit efficiency of working ease to apply on
small region of state (Federated Unit) without any foreign affairs. Also, by that
autonomy power all province has authority to formulate policies in their unit. And
also, by 18th amendment province has authority to apply their own taxes in their
area. Also, in Pakistan federated units divided on basis of identity federalism such
as mostly people of Punjabis live in Punjab and that is also in Sindh, Baluchistan
and KPK that is good for society because if same ethics people lived on curtain
ground their relationship with each other better and stronger and they work
together with ease that is good for society for economical growing and also for
provinces growth. Through that revenue of unit increase and growth of economy
in provinces increase day by day. In result, Pakistan industry growth and their
current foreign relationships are more improve, through that Pakistan import
export become more better and more revenues create. Also, by amendment each
province participates in current political affairs of their provinces and by that
Baluchistan also heavily involved in politics that take actions which is betterment
for their unit.
But that province is answerable to state for their actions Therefore, autonomous
state has less freedom on all actions. But that is also betterment for state because
if province has all power and that unit take any action without any interference
that federated unit take any action which is not good for sovereign states such as,
become another state.
On whole, by federalism in Pakistan after 18th amendment political instability
greatly increased with that each province has right to take any action which is
betterment for their society and province. Also, after that Baluchistan also
involved in politics and become part of democracy. In fact, Baluchistan has led the
way to take local body election in 2013. But every aspect has positive and
negative effects also such as; foreign education, health’s mission only limited to
more developed areas and according to survey, poor national level policies in
health and education as well as larger fiscal deficits and duplication of
bureaucracy.
Provisions of 18th amendment related to Federalism:
By amendment, there is amended Article 25A by that there is state
responsibility to make projects and policies for children’s education there is
compulsory for girls and boys to got education up to age of 16. And it is states
responsibility to make projects and policies for free education and collects funds
for poor people children for their education and through that education provide
to children.
By federalism, provincial government has right to manage departments,
institutions and human resources. Federated unit has also their own finical
budgets which they apply on their unit. It is provincial govt responsibility to make
policies and adjust policies with 18th amendments such as educational, health
policies which is basic need of any province. In results, with federalism in KPK now
education, police departments, tourism, infrastructure, food, agriculture, and
most importantly health will be improved day by day. Also, by amendment
provincial government has also authority resolve public affairs and issues for
provincial economy growth. Nowadays, biggest challenges to any sovereign state
to implements of Laws (rules and regulation), or policies. by Federalism provincial
has direct authorities to easily implements laws and resolve public affairs.
