that has something to do with the provisions of law on wills specifically on matters pertaining
to an administrator or executor. And to aid us in our discussion, may I introduce to you our

Atty: Eto lang po masasabi ko, dasal lang po at sana lumambot ang puso ni Atty. Edding.

school. Ilang taon ko rin po siyang sinuyo at sa wakas sinagot niya na po ako. Mahigit isang

niya dito sa Pilipinas, gagawa siya ng will at ako po ang gusto niyang gawing executor. Hindi
ko po alam kung ano po ba ang ginagawa ng isang executor?

Atty: Magandang Gabi Caller-1… RULE 84 po ng Special Proceedingss ang kasagutan


which is the “GENERAL POWERS OF EXECUTORS AND ADMINISTRATORS POWERS
OF EXECUTOR/ADMINISTRATOR OF THE ESTATE”

1. To have access to, and examine and take copies of books and papers relating to the
partnership in case of a deceased partner;

2. To examine and make invoices of the property belonging to the partnership in case
of a deceased partner;

3. To make improvements on the properties under administration with the necessary


court approval except for necessary repairs;
4. To possess and manage the estate when necessary:
a) for the payment of debts; and
b) for payment of expenses of administration;

5. To maintain in tenantable repairs houses and other structures and fences and to
deliver the same in such repair to the heirs or devisees when directed so to do by the court.

Atty: However, etong general powers of administrator/executor ay may restrictions as


follows:
1. Cannot acquire by purchase, even at public or judicial auction, either in person or
mediation of another, the property under administration.

2. Cannot borrow money without authority of the court.

3. Cannot speculate with funds under administration.

4. Cannot lease the property for more than one year.

5. Cannot continue the business of the deceased unless authorized by the court.

6. Cannot profit by the increase or decrease in the value of the property under
administration.

Atty: klaro po ba Caller-1?

Caller-1: Klaro po at naintindihan ko po… eh Atty., pano po kung sakali pong mamatay siya,
*FAKE CRY* Ano po ba ang kailangan kong gawin?

Atty: A bond should be filed before the executor/administrator enters upon the execution of
his trust which fixed by the court. Further, conditions must be followed:

1. Make an INVENTORY of property which came to his knowledge and possession


within 3 MONTHS.

2. ADMINISTER the estate and from the proceeds pay all debts and charges.

3. Render an ACCOUNT within ONE YEAR

4. Perform all orders of the court.

Atty: In addition, an ADMINISTRATOR’S BOND or the so-called STATUTORY BOND is a


Conditions prescribed by statute forms part of bond agreement. Terms and effectivity of bond
does not depend on payment of premium and does not expire until the administration is
closed. As long as the probate court retains jurisdiction of the estate, the bond contemplates
a continuing liability.

Atty: Naintindihan nyo po ba? Anyway, kung meron po kayong gustong iklaro pa eh madulog
ko po kayong aanyayahin sa PAO po sa Hall of Justice.

DJ: Ayan po, isa na namang kababayan natin ang ating natulungan. Atty… matanong ko
lang, anong rule yung sa bond?

Atty: RULE 81 ng Special Proceedings which is “BONDS OF EXECUTOR AND


ADMINISTRATOR”

DJ: Ang daming talagang tayong natututunan sa programang eto. Another caller na naman.

DJ: Hello po sa inyo, sino po sila?

Caller-2: Magandang gabi po Papa Jack. Ako nga pala si state your name .
DJ: Ano po ba ang maipaglilingkod ko sa inyo?

Caller-2: Ako po ay itinalagang administrator ng yumao kong boyfriend. Kaso may naulila
pala syang asawa at mga anak at ipinakita sa akin gang last will and testament ng kanyang
yumaong asawa na boyfriend ko. Ano po ang implication ng last will and testament ng asawa
sa pagiging administrator ko? Sa kabilang banda po ay ayaw ko ng gulo, ayaw ko na pong
maging administrator ng yumaong boyfriend ko, ano po ang gagawin ko?

DJ: Eto hayaan nating magbigay liwanag si Atty. Awing.

Atty: Magandang gabi sa inyo Caller-2. RULE 82 ng Special Proceedings which is


“REVOCATION OF ADMINISTRATION, DEATH, RESIGNATION AND REMOVAL OF
EXECUTORS OR ADMINISTRATORS” ang kasagutan.

Atty: Sa unang tanong nyo po regarding sa implication ng pagiging administrator nyo sa last
will and testament, the rule provides that It is only when the newly-discovered will has been
admitted to probate that the letters of administration may be revoked by the probate court.
Meaning, if after letters of administration have been granted on the estate of the decedent as
if he had died intestate, his will is allowed and proved by the court, the letters of
administration shall be revoked and all powers thereunder cease, and the administrator shall
forthwith surrender the letters to the court, and render his account within such time as the
court may direct. Further, the discovery of a will does NOT ipso facto nullify the letters of
administration already issued until the will has been proved and allowed pursuant to rule 82
ng Special Procceding.

Atty: Since, ayaw mo naman ng gulo antayin mo nalang ang order ng probate court.

Atty: On the other hand, kung sakaling ikaw parin ang magiging administrator as per court
order at ayaw mo namang ipagpatuloy ang pagiging administrator mo. Eto po ang mga
grounds for resignation or removal of executor/administrator ayon sa section 2, Rule 82”

Grounds
1. neglect to render accounts; (w/in 1 YEAR or when the court directs);

2. neglect to settle estate according to these rules;

3. neglect to perform an order or judgment of the court or a duty expressly provided by


these rules;

4. absconding (abandonment) ; or

5. insanity or incapability or unsuitability to discharge the trust. (Sec. 2)

These grounds are EXCLUSIVE.

And section 3, Rule 82 provides that Lawful acts of an administrator or executor before the
revocation, resignation, or removal are valid unless proven otherwise.

Hence, if a newly administrator or executor is appointed by the probate court, section 4, Rule
82 provides its powers as follows:

1. collect and settle the estate not administered;


2. prosecute or defend actions commenced by or against the former executor or
administrator; and

3. recover execution on judgments in the name of former executor or administrator.

DJ: Ano po ba ang maipaglilingkod ko sa inyo?

Caller-3: Ako po ay isang widow na ngayon at may limang anak, ako po ang nakatalagang
administrator ng estate ng aling yumaong asawa. Ano po ba ang aking role?

DJ: Ipaliwanag mo Atty. Awing.


Atty: Magandang gabi Caller-3. Rule 83 ng Special Proceedings at kasagutan.

You must conduct Inventory and appraisal and it must be made within 3 MONTHS
from the grant of letters testamentary or of administration. (Sec.1)

The approval of an inventory is not a conclusive determination of what assets


constituted the decedent’s estate and of the valuation thereof. Such determination is only
provisional and a prima facie finding of the issue of ownership.

Property claimed by third persons may be included in the inventory as part of the
assets of the estate and the probate court may order such inclusion, but such order of the
probate court is only a prima facie determination and does not preclude the claimants from
maintaining an ordinary civil action for the determination of title.

Caller-3: Ang laki pala ng trabaho nyan Atty. Wala namang akong trabaho at d sapat ang
naiwan pera ng yumao kong asawa pero ang daming nyang property na naiwan. May
magagawa po ba ako?

Atty: Section 3, Rule 83 allows support to be given to the surviving spouse and the “minor or
incapacitated children” of the decedent during the settlement of the estate. Such is called
“allowances for support”. These are subject to collation and deductible from the share in the
inheritance of said heirs insofar as they exceed the fruits or rents pertaining to them.

Caller-3: Matanong ko lang po Atty, sino-sino po ba ang entitled ng allowance?

Atty: The rule provides that Legitimate surviving spouse and Children of the decedent are
entitled allowance during the Proceedings. Further, according to Art. 188 of the Civil Code,
the children need not be minors or incapacitated to be entitled to allowance. Moreover,
Grandchildren are NOT entitled to allowance under Rule 83.

Atty: However, when liabilities exceed the asset of the estate, his widow and children are not
entitled to support pending the liquidation of the intestate estate, on the ground that such
support, having the character of an advance payment to be deducted from the respective
share of each heir during distribution.

Atty: Ayan po. Nasagot ko po ba ang mga katanungan nyo. Anywaykung meron po kayong
