SUBJECT: Relieved Order for Neglect of Duties and Unacceptable Conduct and
Performance while Performing Official Duties and Functions

DATE: February 4, 2019

1. References:
a. Email from UST-Legazpi Hospital management dated January 29, 2019 re:
Violation of SG General Orders (GOs) No. 1, 2, and 11;
b. Email from SIC Anthony F. Sambajon dated February 4, 2019 of the same
violations stated in reference a above and committing unacceptable
conduct and performance while performing official duties and functions;
and
c. TSAI Administrative Offenses/Violations and Corresponding Disciplinary
Penalties.

2. This pertains to the email from UST-Legazpi Hospital management dated

January 29, 2019 requesting this office for the immediate replacement of SG Rommel A.
Abraham of UST-Legazpi Hospital detachment for violation of SG GOs No. 1, 2, and 11
specifically sleeping while posted (please see picture number 1 below taken by a concerned
Doctor).

 3. Today, February 4, 2019, this office received another email from shift-in-charge
Anthony F. Sambajon informing that while he was conducting patrolling inside the hospital
premises at about 3:45am today he found out that SG Abraham was sleeping in sitting position
on a mono block chairs at the main entrance of the hospital (please see picture number 2 below).

4. In addition to this, SG Abraham manifested unacceptable attitude / violent

behavior towards SIC Sambajon for not allowing him to inspect and write anything on his logbook
(Post 1) relative to his findings; uttered foul and silly words, and challenged him to a fist fight
which was witnessed by Police Officers Louie N. Chavez and Mark Kevin G. Belcher who are
also assigned in the hospital as support PNP personnel for Mayor Baldo confinement. This action
of yours is an act of unbecoming a security guard of this agency which is considered prejudicial to
the best interest of the client you are serving.

5. Be reminded that sleeping on duty (SOD) is considered the act of temporary

departure from reality consciousness where the guard on duty losses his awareness of his
surroundings, thereby exposing his area of responsibility (AOR) to lawless elements. The mere
closure of the eyes or anything that holds his weight shall be considered sleeping on duty.

6. In this connection, you are hereby RELIEVED from your current post
EFFECTIVE IMMEDIATELY and directed to explain in writing within five (5) days from receipt of
this memorandum why no disciplinary action should be imposed against you.

7. Your failure to answer this memorandum within the prescribed period shall be
deemed as waiver of your right to be heard. Appropriate action shall be imposed upon you based
on the available documents at hand.
