‫ﱠ‬
‫إﻥ اﳊﻤﺪ ﷲ ﻧﺤﻤﺪﻩ ‪ ,‬ﻭﻧﺴﺘﻌﻴﻨﻪ ‪ ,‬ﻭﻧﺴﺘﻐﻔﺮﻩ ‪ ,‬ﻭﻧﺴﺘﻬﺪﻳﻪ ‪ ,‬ﻭﻧﻌـﻮذ ﺑـﺎﷲ ﻣـﻦ‬
‫ﹼ‬
‫ﻣـﻀﻞ ﻟـﻪ ‪ ,‬ﻭﻣـﻦ ﻳـﻀﻠﻞ ﻓـﻼ‬ ‫ﺳﻴﺌﺎت أﻋﲈﻟﻨﺎ ‪ ,‬ﻣﻦ ﳞﺪﻩ اﷲ ﻓﻼ‬
‫ﴍﻭر أﻧﻔﺴﻨﺎ ‪ ,‬ﻭ ﹼ‬
‫ﳏﻤـﺪا ﻋﺒـﺪﻩ‬ ‫ﻫﺎدﻱ ﻟﻪ‪ ,‬ﻭأﺷﻬﺪ أﻥ ﻻ إﻟﻪ إﻻﱠ اﷲ ﻭﺣﺪﻩ ﻻ ﴍﻳﻚ ﻟﻪ ‪ ,‬ﻭأﺷـﻬﺪ ﹶ ﱠ‬
‫أﻥ ﱠ ﹰ‬

‫ﻭرﺳﻮﻟﻪ ‪ ,‬ﹶﺑﱠﻠﻎ اﻟﺮﺳﺎﻟﺔ ‪ ,‬ﻭأد￯ اﻷﻣﺎﻧﺔ ‪ ,‬ﻭﻧﺼﺢ اﻷﻣـﺔ ‪ ,‬ﻭﻛـﺸﻒ اﷲ ﺑـﻪ ﹸ ﱠ‬


‫اﻟﻐﻤـﺔ ‪,‬‬
‫ﻭﺟﺎﻫﺪ ﰲ اﷲ ﺣﻖ ﺟﻬﺎدﻩ ﺣﺘﻰ أﺗﺎﻩ اﻟﻴﻘﲔ ‪ ,‬ﻓﺼﻠﻮات اﷲ ‪ ,‬ﻭﺳﻼﻣﻪ ﻋﻠﻴﻪ ‪ ,‬ﻭﻋـﲆ‬
‫أﻣﺎ ﺑﻌﺪ‪:‬‬ ‫آﻟﻪ ‪ ,‬ﻭﺻﺤﺒﻪ أﲨﻌﲔ‪.‬‬

‫ﻓﻘﺪ ﺟﺎءت ﻧـﺼﻮص ﻛﺜـﲑة ﻣـﻦ اﻟﻜﺘـﺎب ﻭاﻟـﺴﻨﺔ ﰲ ﺗﻌﻈـﻴﻢ ﺷـﺄﻥ اﻟﻌﻠـﻢ‬
‫اﻟﴩﻋﻲ‪ ,‬ﻭاﻟﺘﻨﻮﻳﻪ ﺑﻤﻜﺎﻧﺘﻪ‪ ,‬ﻭاﻟﺜﻨـﺎء ﻋـﲆ أﻫﻠـﻪ‪ ,‬ﺑـﻞ ﺟﻌـﻞ اﷲ اﳋـﲑ ﻛـﻞ اﳋـﲑ‬
‫ﻭاﻟﺴﻌﺎدة ﻛﻞ اﻟﺴﻌﺎدة أﻥ ﻳﻮﻓﻖ اﷲ اﻟﻌﺒﺪ ﻟﻠﺴﻌﻲ ﰲ ﲢﺼﻴﻞ اﻟﻌﻠﻢ اﻟﻨﺎﻓﻊ‪ ,‬ﻭاﻟﺘﻔﻘﻪ‬
‫ﹺ‬ ‫ﹺ‬
‫ﻳﻔﻘﻬﻪ‬ ‫ﻣﻦ ﹸ ﹺﻳﺮد اﷲﹸ ﹺﺑﻪ ﹶ ﹾ ﹰ‬
‫ﺧﲑا ﹸ ﹶ ﱢ ﹾ ﹸ‬ ‫اﻟﺪﻳﻦ‪ ,‬ﻛﲈ أﺧﱪ ﺑﺬﻟﻚ رﺳﻮﻝ اﳍﺪ￯ ‪ ‬ﺣﻴﺚ ﻗﺎﻝ‪ » :‬ﹶ ﹾ‬
‫ﰲ ﱢ‬
‫ﹺﰲ ﱢ ﹺ‬
‫اﻟﺪﻳﻦ« ‪.‬‬ ‫)‪(١‬‬

‫ﱠ‬
‫ﻭإﻥ ﻣﻦ أﻓﻀﻞ ﻣﺎ ﹸﻳﺒﺘﻐﻰ ﻣﻦ اﻟﻌﻠﻮﻡ اﻟﴩﻋﻴﺔ ﻋﻠﻢ اﻟﻔﻘﻪ‪ ,‬ﻓﻬـﻮ ﻣﻨﻬـﺎ ﺑﻤﻜﺎﻧـﺔ‬
‫ﻋﺎﻟﻴــﺔ‪ ,‬ﻭﻣﻨﺰﻟــﺔ ﻋﻈﻴﻤــﺔ ; إذ ﺑــﻪ ﹸﻳﻌــﺮﻑ اﳊــﻼﻝ ﻭاﳊــﺮاﻡ‪ ,‬ﻭﻋﻠﻴــﻪ ﻣــﺪار ﺻــﺤﺔ‬
‫اﻟﻌﺒﺎدات‪ ,‬ﻭاﳌﻌﺎﻣﻼت ‪ ,‬ﻭﺑﻪ ﺻﻼح أﺣﻮاﻝ اﻟﻌﺒﺎد ﰲ اﳌﻌﺎش ﻭاﳌﻌﺎد‪.‬‬

‫ﻭﻟﺬﻟﻚ ﻧﺠﺪ ﺳﻠﻔﻨﺎ اﻟـﺼﺎﻟﺢ ﺗـﺴﺎﺑﻘﻮا إﱃ ﻫـﺬا اﻟﻔـﻀﻞ اﻟﻌﻈـﻴﻢ ‪ ,‬ﻓـﺎﻫﺘﻤﻮا‬


‫ﺑﺎﻟﻌﻠﻢ اﻟﴩﻋﻲ ﻋﺎﻣﺔ ‪ ,‬ﹶ ﹾ ﹶ‬
‫ﻭأﻭﻟﻮا اﻟﻔﻘﻪ ﻋﻨﺎﻳﺔ ﺧﺎﺻﺔ ‪ ,‬ﻓﻨﺬرﻭا أﻧﻔـﺴﻬﻢ ﰲ ﲢـﺼﻴﻠﻪ ‪,‬‬
‫ﹰ‬
‫ﻭﻛﺘﺎﺑﺔ‪ ,‬ﺣﺘﻰ‬ ‫ﹰ‬
‫ﻣﺪارﺳﺔ ‪,‬‬ ‫ﹰ‬
‫ﻭﺗﺼﻨﻴﻔﺎ‪,‬‬ ‫ﲨﻌﺎ‪,‬‬
‫ﻭﺗﻌﻠﻴﲈ‪ ,‬ﹰ‬
‫ﹰ‬ ‫ﻭأﻓﻨﻮا أﻋﲈرﻫﻢ ﰲ ﺳﺒﻴﻠﻪ ‪ ,‬ﱡ ﹰ‬
‫ﺗﻌﻠﲈ‪,‬‬
‫ﺗﻜﻮﻧﺖ ﺛﺮﻭة ﻋﻠﻤﻴﺔ ﻫﺎﺋﻠﺔ ﰲ ﻣﺼﻨﻔﺎت ﻣﺘﻨﻮﻋﺔ – ﻣﺎ ﺑﲔ ﳐﺘﴫات ‪ ,‬ﻭﻣﻄـﻮﻻت‪,‬‬
‫ﻭﴍﻭح ‪ ,‬ﻭﺣـ ﹴ‬
‫ـﻮاش‪ −‬ﲢﻤــﻞ ﰲ ﻃﻴﺎﲥــﺎ ﻋﻠـ ﹰـﲈ ﹰ‬
‫ﻣﻮﺛﻘــﺎ‪ ,‬ﻭاﺟﺘﻬــﺎدات ﻣــﺴﺘﻨﺒﻄﺔ ‪,‬‬
‫ﻋﻠـﲈ‬
‫ﻓﻮرﺛﻮا ﻟﻨﺎ ﺑﺬﻟﻚ ﹰ‬
‫ﻭأﺣﻜﺎﻣﺎ ﳊﻮادث ‪ ,‬ﻭﻭﻗﺎﺋﻊ ﻣﺴﺘﺠﺪة ‪ ,‬ﻭﻣﺴﺎﺋﻞ ﻣﻔﱰﺿﺔ ‪ ,‬ﱠ‬
‫ﹰ‬
‫ﳎﻴﺪا‪.‬‬ ‫ﹰ‬
‫ﻭﺗﺮاﺛﺎ ﹰ‬ ‫ﹰ‬
‫ﺟﻠﻴﻼ ‪,‬‬

‫زﻣﺎﻥ‬ ‫ﻗﺎﻝ اﻹﻣﺎﻡ أﲪﺪ ﺑﻦ ﺣﻨﺒﻞ ‪ −‬رﲪﻪ اﷲ ‪ ) :−‬اﳊﻤﺪ ﷲ اﻟﺬﻱ ﺟﻌﻞ ﰲ ﹼ‬
‫ﻛﻞ‬
‫ﻭﻳـﺼﱪﻭﻥ‬ ‫اﻟﺮﺳﻞ ﺑﻘﺎﻳﺎ ﻣﻦ أﻫﻞ اﻟﻌﻠﻢ ‪ ,‬ﻳـﺪﻋﻮﻥ ﻣـﻦ ﹼ‬ ‫ﹴ‬
‫ﻓﱰة ﻣﻦ ﱡ ﹺ‬
‫ﺿـﻞ إﱃ اﳍـﺪ￯ ‪ ,‬ﹶ‬
‫ﻭﻳﺒـﴫﻭﻥ ﺑﻨـﻮر اﷲ أﻫـﻞ اﻟﻌﻤـﻰ‪,‬‬
‫ﻣﻨﻬﻢ ﻋﲆ اﻷذ￯ ‪ ,‬ﹸﳛﻴﻮﻥ ﺑﻜﺘﺎب اﷲ اﳌـﻮﺗﻰ ‪ ,‬ﹸ ﱢ‬
‫ﺿﺎﻝ ﹴ‬
‫ﺗﺎﺋﻪ ﻗﺪ ﻫﺪﻭﻩ ‪ ,‬ﻓﲈ أﺣﺴﻦ أﺛﺮﻫﻢ‬ ‫ﻓﻜﻢ ﻣﻦ ﻗﺘﻴﻞ ﻹﺑﻠﻴﺲ ﻗﺪ أﺣﻴﻮﻩ ‪ ,‬ﻭﻛﻢ ﻣﻦ ﱟ‬
‫اﻟﻨﺎس ﻋﻠﻴﻬﻢ ( ‪.‬‬

‫رﲪﻪ اﷲ رﲪﺔ ﻭاﺳﻌﺔ ‪ −‬ﻓﻘﺪ ﻛﺎﻥ ﻣﻦ ﻓﻘﻬﺎء اﳊﻨﻔﻴﺔ اﻟﺒﺎرزﻳﻦ ﰲ ﻋﴫﻩ ‪ ,‬ﻭﻛـﺎﻥ ﻟـﻪ‬
‫ﻣﻜﺎﻧﺔ ﺑﲔ اﻟﻌﻠﲈء ‪.‬‬

‫ﻭﺑﻌﺪ اﻻﺳﺘﺨﺎرة ‪ ,‬ﻭاﻻﺳﺘﺸﺎرة‪ ,‬ﻭﻓﻘﻨـﻲ اﷲ ﻋـﺰ ﻭﺟـﻞ أﻧـﺎ ﻭﳎﻤﻮﻋـﺔ ﻣـﻦ‬

Day of Judgment, but after:This is a letter of introduction for a
master's degree at the College of Sharia and Islamic Studies at
Umm Al-Qura University (Department of Islamic Studies Center),
which is about achieving a book (issues Badriyah elected fatwas
Alzaaria) - "Separation in the difference between contractors" to
