,(e) "small.scale mining contractor" refetrs to an in-
dividual or a eooperative of small+cale miners, 'reg-
istered with the Securities and Exchange Com:rrission
or other appropriatd governinent agency, which has
entered into an agreement with the State for the srnall-
scale utilization of a plot of .mineral lancl within a people's ′

small-scale mining area;

(f) "Active mining area" refers to areas under aetual
exploration, development, exlrloitation or commercial pro-
duction as determined by tlie Secretary iliter the neees-
sary field investigation or veriflcation including contiguous
and geologically related aicas belonging to the same
claimowner arfr/or under coutract with an operator, but
in no case to exeeed the ma:rimum area allowed by law;
(g) "Existing miniug riglrt" refers to perfected and
subsistiug , claim, Iease, lic:nse ol permit covering a
'mineralized area prior to its declaration as a people's
small-scale mining area;
(h) ",Claimowner" refers to a holder of an existing
mining risht;
(i) "Processor" refers to a person issuecl a license to
engag:e in the treatmbnt of minerals or ore'bearing ma.
terials such as by gravity concentration, lcaching br:ne-
ficiation, cyanidation, cutting, sizing, polishing antl other
similar activities;
(j) "License" refers' to the privilege granted to a
person to legitimately pursue his cc.cupation as a smell-scirle
miner or processor underthis-Act;
(k) "Mining plan" refers to a two'year prograrn of
activities 'and methodologies employed in the extraction
and prod,uction of miuerals or orefrearing materials,
including the finanlial plan and other resources in
support thereof;
(I) "Director" rofers to the regional"executive director
of the Department of Ilnvironment and Natural Re-
