Hey Pranav,

ADR Class, week 10 was essentially about a practical exercise on Mediation. The case
study for this was uploaded in the materials for Week 10 (Attached herewith) The two sides,
Jersconsult and Machinvest, were in dispute and a mediation took place. Each side had the client and
the lawyer and there was the Mediator (and co-Mediation was also tried). It is important that you read
the case and understand it well: for each side and as the Mediator. Please remember that Mediation is
an assisted Negotiation. This means that notions such as BATNA, ZOPA etc. apply. Also consider that
caucuses are also permitted. This is an institutional arbitration under the ICC Mediation Rules. You will
find the rules available in the materials for Week 10.
It was also recommended to have a quick browse through C. Moore’s book on The Mediation Process
(2014, 4th edition, Wiley). Please note that you can read this book online: https://ebookcentral-
