JUDICIAL AFFIDAVIT OF
SATURNINO M. SIMANGAN

Conformably with A.M. No. 12-8-8-SC, Plaintiffs respectfully submit

the Judicial Affidavit of Saturnino M. Simangan, in lieu of his oral
testimony on direct examination:

FORMAL OFFER OF TESTIMONY

The testimony of Saturnino M. Simangan is being offered for the

following purposes:

1) To serve as his direct testimony.

2) To identify and attest to the veracity of the exhibits.

3) To prove the truth of the allegations stated in the Amended

Complaint with respect to the deceased Melvin C. Simangan.
 4) To prove that plaintiffs Heirs of the deceased Melvin C. Simangan
are is entitled to the relief as stated in the complaint.

DIRECT EXAMINATION

The questions were propounded by Atty. ___________________ at

his office located at Solana, Cagayan Province on ___________________,
in the presence of his paralegal, Ms. ________________________ who
recorded the taking of the testimony of the witness:

1. Q: Sumusumpa ba kayo na magsasabi ng katotohanan at

pawang katotohanan lamang sa okasyon na ito?

A: Opo.

2. Q: Maaaring sabihin niyo po ang inyong pangalan, status,

tirahan, edad, at hanapbuhay?

A: Ako po si Saturnino M. Simangan, ___ years old, kasal

kay Delia C. Callueng at naninirahan sa 191
Bagumbayan St. Basi West,Solana, Cagayan Valley ,
isang magsasaka.

3. Q: Nalalaman po ba ninyo na ang lahat ng sasabihin ninyo ay

totoo lamang at kung mapapatunayan na kayo’y
nagsisinungaling ay maari kayong makasuhan ng
Perjury?

A: Opo.

4. Q: Kilala ba ninyo si Melvin C. Simangan?

A: Opo, anak ko po siya.

5. Q: Ano po ba ang inyong katibayan na si Melvin C.

Simangan ay inyong anak?

A: Ang katunayan po ay ang Birth Certificate ni Melvin

C. Simangan na talagang anak ko siya na kalakip ng
salaysay na ito bilang Exhibit “LL”.

6. Q: Nasaan na ang inyong anak ngayon?

A: Si Melvin C. Simangan, na anak ko, ay namatay noong

Abril 27, 2014 dahil sa plane crash.
 7. Q: Kailan nangyari ang plane crash na sinasabi ninyo?

A: Ang plane crash ay nangyari noong Abril 27, 2014 sa

Bagabag, Nueva Vizcaya.

8. Q: Anong eroplano at sino ang piloto nito?

A: Beechcraft Baron B55 po.

9. Q: Sino-sino ba ang kasama ng anak ninyo doon sa

bumagsak na eroplano?

A: Philip Jubane, Christopher Evan Borja, at Leilani Naga

po.

10. Q: Sabi ninyo, namatay ang inyong anak na si Melvin C.

Simangan. Mayroon po ba kayong ebidensya na
magpapatunay na namatay angi nyong anak?

A: Mayroon po, yung Certificate of Death na kalakip ng

salaysay na ito bilang Exhibit “MM”.

11. Q: Ano po ba ang hanapbuhay ng inyong anak, kung

mayroon man, noong bago siya mamatay?

A: Si Melvin C. Simangan ay namasukan sa Bureau of Soils

and Water Management bilang assistant ng
piloto na nagka-Cloud Seeding.

12. Q: Bakit kayo nandirito ngayon sa tanggapan ni Atty. Santos

at nagbibigay ng salaysay?

A: Nandito ako sa harapan ni Atty. ___________dahil

nagclaim ako ng insurance sa aking anak na namatay sa
plane crash.

13. Q: Ano ang karapatan ninyo para magclaim ng insurance ng

anak ninyo?

A: Sapagkat ako po at ang aking maybahay na si Delia C.

Callueng ang kanyang tunay na mga magulang at
tagapagmana.

14. Q: Ano ang inyong katibayan na kayo ng inyong asawa ang

mga magulang ni Melvin C. Simangan?
 A: Ang kanyang Birth Certificate po na kalakip ng salaysay na
ito bilang Exhibit “NN”.

15.Q: Magkano ba ang halaga ng inyong insurance claim?

A: US $25,000.00 po sang-ayon sa insurance policy ng QBE

Insurance Company.

16. Q: Bago kayo nagfile ng Amended Complaint, mayroon po

ba kayong ginawang hakbang upang masingil o makolekta
ang insurance coverage ng anak ninyo?

A: Nakipagcoordinate po kami sa lawyer ng Grand

Aviators and Aviation Corporation, kaya nagbigay po
kami ng Power of Attorney kay Atty. Arturo S. Santos
bilang aming kinatawan sa kaso, kalakip ng salaysay na ito
ang Special Power of Attorney bilang Exhibit “OO”.

17. Q: Ano ang nangyari doon sa insurance claim ninyo?

A: Walang nangyari. Hindi po kami binayaran.

18. Q: Ano ang ginawa ninyo noong hindi kayo nabayaran ng

insurance company?

A: Sumama kami sa pagfile ng kaso at gumastos ng 20%

bilang Attorney’s fees kung sakaling nagtagumpay.
