INFORMATION

The undersigned City Prosecutor accuses COCO S. RACHA, a resident of 35

Lokokayo Street, Divisoria, Zamboanga City, Philippines of the crime ROBBERY,
defined and penalized under Article 293 of the Revised Penal Code, committed as
follws:

That on or about 13th of February 2019, in the City of Zamboanga,

Philippines, and within the jurisdiction of this Honorable Court, the above-named
accused, did then and there, willfully, unlawfully and feloniously Robbed MC
Convenience Store

I, COCO S. RACHA, of legal age, Filipino and a resident of 35 Lokokayo Street,

Divisoria, Zamboanga City, after having been sworn to in accordance with law
hereby depose and state:

1. That I am the respondent in Criminal Case NPS DOCKET NO.: V-01-

INQ-45B-10011 for the crime of Robbery under Article 293 of the
Revised Penal Code;

2. I am executing this Counter-Affidavit and comment to the Complaint-

Affidavit of MATCHO L. CAO, who is under investigation by this
Honorable Office in connection with the robbery case he filed against
me.

3. On February 13, 2019 at about 9:00 pm in the evening the time that
the alleged robbery happened, I was with my friends Berto Martines
and Dodong Jutay in the internet café playing Dota.

4. That the MC Convenience Store were the alleged robbery occurred

is just fronting the internet café where we are playing.
 5. That when people noticed that there is a commotion in the fronting
convenience store we all went out to check what happened.

6. My friends and I saw the man running out of the Store heading
towards the dark street.

7. That when the store owner came out he was yelling and shouting at
me, accusing me as the criminal who robed his store.

8. Macho Cao was very furious and wanted to attack me, the people in
the area stopped him from attacking me.

9. I deny the accusation of robbery filed against me by MATCHO L. CAO

10. In total, the complainant have mistaken me for someone else.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed that

the instant criminal complaint be DISMISSED for lack of merit

Further, the respondent respectfully prays for such and other

reliefs as may be deemed just and equitable in the premises.
