CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract made and entered by and between:

___________________________________ , a national government agency

with principal office address at______________________ represented herein by
herein referred to as the “First Party”;

- and -

______________________ of legal age, Filipino and with residence address

at ________________________________, herein referred to as “Second Party”;

WITNESSETH:

WHEREAS, the First Party is in need of the services of the Second Party who
shall render work not performed by the regular personnel of the First Party;

WHEREAS, the Second Party possesses the education, experience, and skills
required to render the services needed by the First Party;

WHEREAS, the Second Party has signifies his/her intention, to which the First
Party has accepted, to provide the services needed by the latter;

WHEREAS, the Second Party hereby attests that he/she is not related within
the third degree of consanguinity or affinity to the: 1) hiring authority and/or 2)
representative of the First Party; that he/she has not been previously dismissed from
government service by reason of an administrative offense; he/she has not already
reached the compulsory retirement age of sixty-five (65);

WHEREAS, it is understood that this Contract does not create an employer-

employee relationship between the First Party and Second Party, that the services
rendered hereunder are not considered and will not be accredited as government
service; and that the latter is not entitled to benefits enjoyed by the regular personnel
of the First Party.

WHEREAS, the Second Party shall perform work at a time and schedule to be
agreed upon by both parties;

NOW, THEREFORE, both parties agree to the following:

Section 1. This Contract shall cover the period January 07, 2019 to February 28,
2019, subject to Section 5 hereof. Memorandum No. 2017-507 dated 29 December
2017 shall form part of this contract.

Section 2. The Second Party is hereby contracted as LAWYER for

________________________and shall perform the following:
a. Assist the _______________Regional Office in filling cases in court;
b. Prepare pleadings for and in behalf of the _______________ Regional Office;
c. Provide legal advice to __________________ on official matters;
d. Assist the hearing officers on administrative proceedings handled by the
____________ Regional Office; and

 e. Perform such other related work that may be assigned by his/her immediate
supervisor (other task).

Section 3. For services rendered under this Contract, the Second Party shall receive
a monthly compensation of Forty Seven Thousand and Seven Hundred and
Seventy Nine Pesos (₱47,779.00), inclusive of tax, to be paid on monthly basis or
Two Thousand Three Hundred Eighty Eight Pesos and Ninety Five Centavos
(₱2,388.95) per day, plus a premium of Twenty (20) Percent, chargeable against
____________ Funds.

As the basis for payment, the Second Party shall submit proof of services rendered
during office hours and field work to be certified by the CENR Officer and report of
status of cases assigned. Proof of attendance may be in the form of Daily Time
Record, logbook, travel orders, and other such official records of services rendered.

Section 4. In view of the nature as well as the necessity of his/her tasks, the Second
Party shall be entitled to attendance to seminars, and actual transportation expenses
chargeable to _______ funds, subject to the usual accounting and auditing rules and
regulations.

Section 5. Supplemental guidelines will be provided through a memorandum issued

by the _______.

Section 6. The Chief, Legal Division shall have direct control and supervision over
the prosecution and monitoring of all cases that the lawyers will handle. The latter
shall ensure that he former has timely access to all notices, pleadings, and other court
processes.

The lawyers shall submit reports on the status of cases they are handling to the Chief,
Legal Division, on the date prescribed by the latter.

The lawyers shall coordinate directly with the Chief, Legal Division on all legal matters
affecting the _______ or the Implementing ___________.

Section 7. This Contract may be terminated by either party for any reason as may be
deemed appropriate before the expiration of the period indicated in Section 1 hereof,
giving the other party prior written notice to less than fifteen (15) days before the
intended date of termination.
