מבקש העיון ,דר’ יוסף צרניק ,מגיש בזאת בקשה להגשת תשובה בעניין טענות בדבר תעודת
החיסיון ,ותשובה לתגובת המשיבים מיום 03 לאפריל ,2019 ,כדלהלן:
תגובת המשיבים ע"י פרקליטות המדינה אומרת בסעיפים ,3,4,5 שההסכם עם מדינה .1
שלישית ,חוסה תחת תעודת חיסיון:

.5במצב הדברים האמור ,ומשקיימת תעודת חיסיון על המסמכים שהעיון בהם
מבוקש ,המדינה תטען כי הדין מחייב את דחיית בקשת המבקש.
בקשת העיון איננה מבקשת לעקוף את תעודת החיסיון .תעודת חיסיון משמעותה .2
שהראיות שחוסות תחת תעודת החיסיון אינן קבילות" – אין אדם חייב למסור ,ובית
המשפט לא יקבל ,ראיה אם ראש הממשלה או שר הביטחון הביע דעתו ,בתעודה
חתומה בידו ,כי מסירתה עלולה לפגוע בביטחון המדינה ,או אם ראש הממשלה או שר
החוץ הביע דעתו ,בתעודה חתומה בידו ,כי מסירתה עלולה לפגוע ביחסי החוץ של
המדינה) "...סעיף)44 א( לפקודת הראיות(.
לפיכך ,במקרה שלפנינו ,ככל שהמשיבים הגישו את הראיה לבית המשפט ,הרי שהראיה .3
– ההסכם עם מדינה שלישית יצאה מתחומה של תעודת החיסיון ,הפכה לקבילה והיא
חלק מתיק בית המשפט .בכך אין לגרוע ,כמובן ,מן העובדה ,שהיא התקבלה במעמד צד
אחד ,בדיון בדלתיים סגורות ,ולפיכך חל עליה איסור פרסום.
כפי שנקבע לא אחת בהלכות של בית המשפט העליון – העובדה שחל איסור פרסום .4
אינה מונעת מראש את זכות העיון) בג"ץ 5699/07 יובל יועז ,עיתונאי נ' היועץ המשפטי
לממשלה ,החלטה מיום.(23.4.2009
לפיכך ,שב מבקש העיון וטוען ,שמן הראוי שבית המשפט יקבע קודם לכל קביעה .5

Requester of Inspection’s Request for Leave to File Reply and Reply, Pertaining to
Certificate of Confidentiality
Requester of Inspection, Joseph Zernik, PhD, files herein his request for leave to file
reply and reply, pertaining to Certificate of Confidentiality claims in the April 03, 2019
Respondents’ response, as follows:
1. Respondents’ response by the State Attorney says in paragraphs 3,4,5, that the
“Agreement with Third Nation” is protected by a Certificate of Confidentiality:
3. On March 30, 2014, the Prime Minister signed a Certificate of
Confidentiality, pursuant to this authority in Article 44 of the Evidence Code
(1971)…

5. Under such circumstances, since a Certificate of Confidentiality is in
effect, pertaining to the records, inspection of which is requested, the State
argues that the Requester’s request should be denied by law.
2. The Request to Inspect is not trying to circumvent the Certificate of
Confidentiality. The Certificate of Confidentiality means that the evidence
under such Certificate is inadmissible “a person is not required to file, and the
Court shall not enter any evidence, if the Prime Minister or the Minister of
Defense opine, in a certificate signed by their hand, that its filing may harm
State security or State foreign relations… (Article 44(a) of the Evidence Code).

3. Therefore, in the case at bar, to the degree that the Respondents indeed filed the
evidence in court, such evidence – the Agreement with Third Nation – is no
longer protected under the Certificate of Confidentiality, and it became
admissible and part of the Supreme Court file. Under such circumstances, such
evidence was still filed ex parte in a hearing behind closed doors, and is still
under prohibition of publication.
4. As repeatedly ruled by the Supreme Court – the existence of prohibition of
publication does not prevent a priori the right to inspect (April 23, 2009
Decision in Yoaz v Attorney General 5699/07).
5. Therefore, Requester of Inspection repeats his argument, that the Court should
first determine a matter of fact: Is there at all a copy of the Agreement with
Third Nation in instant court file (8101/15)? In case there is no copy of the
Agreement with Third Nation in instant court file, then instant Request to
Inspect is moot. On the other hand, if the Agreement with Third Nation was
indeed filed in instant Supreme Court file, such Agreement is no longer
protected under the Certificate of Confidentiality, as claimed by the
Respondents, and the Request to Inspect is valid.
