AGREEMENT

This Agreement executed this _______________ at ____________________, by and between:

JOSE E. BAUTISTA JR., of legal age, Filipino, married, and a resident of L1B6 Rosario Subd.,
Tacas, Jaro, Iloilo City (hereinafter referred to as “the FIRST PARTY”).

-and-

GERALD S. JAMOLA, Filipino, 20 years old, a resident of Brgy, San Isidro, Jaro, Iloilo, and
ERIC TAMAYO, Filipino, 22 years old, a resident of Zarraga, Iloilo, (hereinafter referred to as “the
SECOND PARTY”).

WITNESSETH:

WHEREAS, the FIRST PARTY and the SECOND PARTY was involved in incident wherein
the Second Party with intent to gain and without the consent of the owner took the motor vehicle
belonging to the First Party specifically described as 2008 Ebony Black DMAX SE 4x2 bearing plate
number FGH – 521;

WHEREAS, the SECOND PARTY after taking the above – described vehicle drove the said
vehicle under the influence of alcohol resulting to a vehicular accident causing damage to the subject
vehicle in the amount of ______________________________________________________;

WHEREAS, the Parties agreed to settle the case wherein the First Party shall desist from filing
the appropriate legal action against the Second Party subject to the latter’s compliance with this
Agreement;

NOW THEREFORE, in consideration of the foregoing and the further covenants hereinafter
set forth, the parties agree as follows:

1. The Second Party agrees to indemnify the First Party for the damage caused to the vehicle
in the amount of TWO HUNDRED THOUSAND PESOS (P200,000);

2. That the Second Party shall pay the First Party

_______________________________________ every month thereafter until the remaining
balance of ________________________________________________ is paid;

3. That after the full satisfaction of the settlement agreed upon, the First Party shall execute
an Affidavit of Desistance involving the said incident.

4. The signatories to this Agreement hereby represent and warrant that they had read and
fully understand this Agreement before signing the same;

6. The foregoing covenants are not contrary to law, morals, or public policy and the
parties bind themselves to comply strictly with their undertakings.
