The letter has been withdrawn following direction from defence minister Nirmala Sitharaman
NEW DELHI: In a major decision, the defence ministry on Friday announced withdrawal of a controversial note it had issued over two years back on status equivalence between military officers
and their civilian counterparts, which had triggered widespread anguish in the armed forces.
"The Ministry of Defence letter dated October 18, 2016 on the issue of equivalence between Armed Forces officers and Armed Forces Headquarters Civil Services (AFHQ CS) Officers is
withdrawn," the defence ministry said.

It said the letter has been withdrawn following direction by defence minister Nirmala Sitharaman.
The ministry further said the cadre restructuring of AFHQ CS as approved by the Union Cabinet shall be duly implemented.
"Designations to be created in consequence of the additional posts sanctioned by the Cabinet will be done in consultation with Service HQs," it said.
There has been growing resentment among the military officers who have been insisting that the current status equivalence was flawed and that the government must address their concerns.
For example, according to current norms, director-level officers have been put on the same level with the directors of the Armed Forces Headquarters-cadre. The military officials have been
insisting that Lt Colonel is equivalent to directors of AFHQ cadre.
In the October 18, 2016, letter, the defence ministry, had made the rank equivalence between civilian officers and serving military officers on the basis of their functional responsibilities.
Following the order, for example, a Principal Director in AFHQ was made equivalent to a Major General, a Director was made equivalent to a Brigadier and a Joint Director was made on par
with a Colonel.
The ministry said "local designations" assigned to both service and civilian Officers in Service Headquarters/ Inter Service Organisations (ISOs) is also withdrawn.

It also said that both Service and Civilian Officers will use their respective cadre designations only.
"So far as the Channel of reporting/rendition of Annual Performance Appraisal Report (APAR) is concerned, status quo ante is hereby restored, i.e., the position which existed prior to the issue
of MoD letter dated 18 October 2016 shall prevail," the ministry said.

NEW DELHI: The Rajya Sabha was on Friday adjourned sine die without taking up the triple talaq bill for lack of consensus over the Opposition’s demand to refer it to a select committee.
Chairman Venkaiah Naidu, while thanking the members for cooperation in ensuring passage of nine government Bills and other business during the session, regretted the substantial loss of
functional time on account of disruptions.
“... Though Parliament is a political institution, it cannot be an extension of politics in its typical sense which is marked by deep divisions and acrimony ... It is unfortunate that despite discharging
its responsibilities to a great extent, the august House ends up losing some degree of esteem of the people on account of disruptions and subsantial loss of time ... Intense and passionate
submissions and debates are the order of democracy, but disruptions are certainly not. I urge upon the Hon’ble members to seriously introspect in this regard,” Naidu stated in his valedictory
remarks at conclusion of the winter session.
The initial days of the session had seen frequent disruptions as Congress insisted on an apology from Prime Minister Narendra Modi over his remarks against his predecessor Manmohan Singh
during the Gujarat poll campaign. However, the deadlock was eventually resolved, enabling Rajya Sabha to function normally.
A review of the proceedings reveals that a total 41 hours of business was transacted while over 33 hours lost to disruptions over 13 sittings of Rajya Sabha. Nine government bills were passed, 19
private members’ bills introduced, 46 starred questions answered orally, 51 Zero Hour submissions made, 28 special mentions taken up and two short-duration discussions held on state of the
economy as well as air pollution in Delhi. Rajya Sabha even created a record on January 2 by taking up all starred questions after a gap of 15 long years.
Stating that the House had its highs and lows, Naidu said the high point was that both the sides reiterated their commitment to respect and uphold the high office of the Prime Minister and former
PM. Another high point, he said, was that all sections of the House spoke in one voice regarding former Indian naval officer Kulbhushan Yadav’s meeting with his family members in a Pakistani
jail.
As for the ‘lows’, Naidu said it was a matter of “deep discomfort” that the House had lost over 33 hours of valuable working time. “..time is not on our side and we need to stretch ourselves to
make up for the missed opportunities and time..The legislature of our country including the apex Parliament need to quickly evolve the way we conduct our proceedings so as to meet the needs
of our evolving nation,” he said.

NEW DELHI: The government does not propose to introduce a system of single window clearance for industries by relaxing the environmental protection laws, the Lok Sabha was told on
Friday.
Minister of State for environment Mahesh Sharma said that the government also does not propose to amend the environment protection laws to promote major projects.
"The government does not proposes to amend the environment protection laws so as to promote major projects."
"The government does not propose to introduce a system for single window clearance for industries all over the country by relaxing the environmental protection laws," he said.
However, he maintained that to bring more transparency in the environment, forest and wildlife approval processes for development projects, the ministry has rolled out a single window system
for submission of application from July, 2014 at the central level.

It also rolled out a single window system for submission of application from July 2015 at state level in the state Environment Impact Assessment Authority (SEIAA) and on June 18, 2016 at
district level in the District level Environment Impact Assessment Authority (DEIAA).
Environment ministry is the nodal ministry for implementation of the Environment (Protection) Act, 1986, the Air (Prevention and Control of Pollution) Act 1981 and the Water (Prevention and
Control of Pollution) Act 1974 for enforcing environmental protection, he said.
Asked whether the government has conducted any study regarding the functioning of the green tribunal, he replied in the negative.
He said the structure, procedure and functioning of National Green Tribunal are governed by the National Green Tribunal Act, 2010 and the National Green Tribunal (Manner of Appointment of
Judicial and Expert Members Salaries, Allowances and other Terms and Conditions of Service of Chairperson and other Members and Procedure for Inquiry) Rules, 2010.
"There is no amendment proposed in the Constitution and functions of the National Green Tribunal.
"The relevant provisions under the NGT Act, 2010 have been amended vide Tribunal, Appellate Tribunal and other Authorities (Qualifications, Experience and other Conditions of Service of
Members) Rules, 2017 notified on 01.06.2017 by the Department of Revenue, Ministry of Finance under the Finance Act, 2017," he said.

NEW DELHI: The Supreme Court on Friday quashed proceedings against CBI officials who had wrongly tried to enter the house of a sitting Orissa High Court (HC) judge under mistaken
identity to conduct raid and search of premises in connection with medical admission scam.
A bench of Justices A K Sikri and Ashok Bhushan quashed the FIR lodged against the officials after the agency told the court that it had tendered unconditional apology to the Chief Justice of
the HC and the concerned judge for the mistake and it was accepted by them.
Odisha police had filed a case of trespass against a team of CBI officials trying to enter the house of the sitting judge of the Orissa HC in in the intervening night of 19-20 September to conduct a
raid and search. They had gone to raid the house while searching for a former HC judge but he had vacated the premise seven years back after retirement. The officials immediately withdrew
from the spot after they came to know that a sitting HC judge was residing at the house now. The officials had gone there on the basis of information received from internet showing that the
former judge was living there.
The agency told the apex court that the mistake was inadvertent and bona fide and the FIR should be quashed as the concerned judge had already accepted the apology.

"It is submitted and reiterated that the whole incident which happened in the night intervening 19-20 September was unfortunate yet unintended, inadvertent and bona fide mistake during
carrying out of the search warrant. The deponent, on behalf of the entire unit involved in the case, once again expresses an unqualified apology to the institution of the High Court as also to the
honourable judge, at the entrance of whose residence the team members reached under a bona fide mistake," CBI said in its affidavit.
Taking CBI's affidavit on record, the bench quashed the FIR against CBI officials.
