E-Judiciary (Establishment, Utilization and Management) Act

E-Judiciary refers a digitized judicial system established and regulated using technology
intensively. The objective of the study is to determine how judicial records are organised and
preserved in relation to their accessibility and effective utilization by judicial officers. There
are different types of judicial records which include case files, registers and cause books.
Records are preserved or appropriated for preservation by the institution on its legitimate
successor as evidence of its functions, policies and procedures. The digital revolution offers
significant opportunities to those who provide legal assistance and education to low-income
people and communities. Judicial records will enable to access for general people.
But a number of Challenges confronting the management of judicial records is the barrier of
easy access. There are lapses in the generation and management of record managers and lack
of comprehensive and uniform policy has hampered the management and utilisation as well as
the efficiency of having E-judicial records. Digital Case Management System (DCMS) can
reduce the high possibility of distortion of documents as well as enhance the proper use of
working hours disposing cases promptly. Not only developing the structural advancement but
also advancement of system regulating judicial activities should be emphasised equally to
advance the administration of justice.
In the context of Bangladesh, Constitutionally she possesses an independent judiciary which is
been guaranteed and enshrined in landmark Secretary, Ministry of Finance vs. Masdar
Hossain & others case by the apex Court.
