AM ENDM ENT REG ULATIO NS, 1989

The Board of Trustees of Visakhapam am Port Trust hereby


publish the following Regulations m ade by it in exercise of the powers
conferred by Clause (b) of Section 28 of the M ajor Port Trusts Act,
1963, the sam e having been published in pursuance of Sub-Section
(2) of Section 124 of the said Act and after having been am ended and
approved by the Central G overnm ent as required by Sub-Section (1)
of Section 124 thereof, nam ely:

1. SHO RT TITLE AND CO M M ENCEM ENT:

(i) These Regulations m ay be called the Visakhapatnam Port


Em ployees' (W elfare Fund) Regulations, 1967.

(ii) They shall com e into force on the date _of their publication in
the O fficial G azette.

2. DEFINITIO NS:

In these Regulations, unless the context otherwise requires:

(1) "Board" "Chairm an" and "Deputy Chairm an" shall have the
sam e m eanings as in, the M ajor Port Trusts Act, 1963;

(2) "Em ployee" m eans an em ployee of the Board whether


perm anent or 'tem porary and includes any em ployee on
foreign service and any perm anent or tem porary em ployee
of the Central and State G overnm ent or a local or other
authority on deputation with the Board.

(3) "Fund" m eans the Visakhapatnam Port Em ployees' W elfare
Fund form ed under Rule 3.

(4) "G eneral Account" m eans the general account of the Board.

3. CO NSTITUTIO N O F THE FUND:

There shall be form ed a fund to be called the Visakhapatnam


Port Em ployees' W elfare Fund and there shall be credited thereto:

(a) Such contributions from the general account as m ay be


sanctioned by the Board from tim e to tim e;

(b) fines recovered from the em ployees;

(c) contributions to any Em ployee' provident fund withheld under


the relevant rules regulating the Provident Fund;

(d) Interest and profit on investm ents belonging to the fund; and

(e) Any other sum or property m ade over to the Fund by way of
gift or donation.

FUND:

The Fund shall be adm inistered by the Chairm an who m ay, at


h;~ discretion, constitute an Advisory Com m ittee for the purpose.

5. EXPENDITURE FRO M THE FUND:

The objects on which the Fund m ay be expended shall be the


following, nam ely:
(a) donations, subscriptions and gift to institution, clubs, co-
operative societies etc., connected with welfare of em ployees
and their fam ilies;
(b) literacy classes, handicraft education and reading room s for
em ployees and their fam ilies;
(c) special rewards to em ployees for saving of life and property
and other m eritorious acts within the Port;
(d) to provide artificial lim bs or other aids to em ployees who
are partially or perm anently disabled due to accidents on
duty;
(e) Paym ent towards cost of special drugs recom m ended by the
M edical O fficer of the Board for the use of the em ployees;
(f) Financial assistance to the em ployees and the m em bers of
their fam ilies in acute distress;

(g) G rants for conducting sports, com petitions, dram as, m usic,
film shows, bhajans, etc., for em ployees and celebrations of
Independence and Republic Days by em ployees;

(h) Paym ent of hot and cold weather charges for the benefit of
em ployees;

(i) G rant of Scholarships: Financial assistance towards


education for em ployees and their children; and

(j) Any other item of expenditure for the benefit of em ployees


and their fam ilies at the discretion of the Chairm an.

6. DISBURSEM ENT FRO M FUND:

Disbursem ent from the Fund shall be m ade either with the
"specific sanction of (a) the Chairm an or (b) by the Deputy
Chairm an or any authoruy .iuthorized by the Chairm an" and in
accordance with the general instructions of the Chairm an from
tim e to tim e.

7. M AXIM UM AM O UNT IN FUND:

The m axim um am ount that m ay be held in the Fund shall be


lim ited to Rs. 25,00,000/-.

8. DISPO SAL O F SURPLUS IN THE FUND:

Any surplus in the Fund over and above the prescribed m axim um
shall be credited to the Board's general account.

9. INTERPRETATIO N:

In the case of doubt, all questions relating to this Fund shall be


decided by the Chairm an.
