100% of average daily salary credit for 60 days (normal) or 78 days (caesarian
delivery), provided:
a. Employee as paid at least 3 monthly contributions in the 12-month
period immediately preceding the semester of her childbirth or
miscarriage;
b. That the employee shall have notified her employer of her pregnancy
and the probable date of her childbirth;
c. The full payment shall be advanced by the employer within thirty (30)
days from the filing of the maternity leave application;
d. Only for the first 4 deliveries or miscarriages.
Paternity Leave
Married male employees are entitled to a paternity leave of seven (7) days with
full pay for the first four (4) deliveries of the legitimate spouse with whom he
is cohabiting.
o The male employee applying for paternity leave shall notify his
employer of the pregnancy of his legitimate spouse and the aexpected
date of such delivery.
Acts covered:
A. Physical Violence: acts that include bodily or physical harm;
Venue:
Regional Trial Court where the crime or any of its elements was committed at
the option of the compliant.
Rights of Victims:
a. to be treated with respect and dignity;
b. to avail of legal assistance from the PAO of the Department of Justice
(DOJ) or any public legal assistance office;
c. To be entitled to support services form the DSWD and LGUs';
d. To be entitled to all legal remedies and support as provided for under the
Family Code; and
e. To be informed of their rights and the services available to them including
their right to apply for a protection order.
Entitled to Leave
Victims are entitled to take a paid leave of absence up to ten (10) days
in addition to other paid leaves under the Labor Code and Civil Service Rules
and Regulations, extendible when the necessity arises as specified in the
protection order.
