The undersigned complainant accuses JAIME JOSE Y GOMEZ, BASILIO PINEDA, JR. Alias "BOY,"
EDUARDO AQUINO Y PAYUMO alias "EDDIE" and ROGELIO CAÑAL Y SEVILLA alias "ROGER," as
principals, WONG LAY PUENG, SILVERIO GUANZON Y ROMERO and JESSIE GUION Y
ENVOLTARIO as accomplices, of the crime of Forcible Abduction with rape, committed as follows:

That on or about the 26th day of June, 1967, in Quezon City, and within the jurisdiction of this
Honorable Court, the above-named principal accused, conspiring together, confederating with
and mutually helping one another, did, then and there, wilfully, unlawfully and feloniously, with
lewd design, forcibly abduct the undersigned complainant against her will, and did, then and
there take her, pursuant to their common criminal design, to the Swanky Hotel in Pasay City,
where each of the four (4) accused, by means of force and intimidation, and with the use of a
deadly weapon, have carnal knowledge of the undersigned complainant against her will, to her
damage and prejudice in such amount as may be awarded to her under the provisions of the civil
code.

That WONG LAY PUENG, SILVERIO GUANZON y ROMERO, and JESSIE GUION y
ENVOLTARIO without taking a direct part in the execution of the offense either by
forcing, inducing the principal accused to execute, or cooperating in its execution by an
indispensable act, did, then and there cooperate in the execution of the offense by
previous or simultaneous acts, that is, by cooperating, aiding, abetting and permitting the
principal accused in sequestering the undersigned complainant in one of the rooms of the
Swanky Hotel then under the control of the accused Wong Lay Pueng, Silverio Guanzon y
Romero and Jessie Guion y Envoltario, thus supplying material and moral aid in the
consummation of the offense.

That the aforestated offense has been attended by the following aggravating
circumstances:
 1. Use of a motor vehicle.

2. Night time sought purposely to facilitate the commission of the crime and to make its
discovery difficult;

3. Abuse of superior strength;

4. That means were employed or circumstances brought about which added ignominy to
the natural effects of the act; and

5. That the wrong done in the commission of the crime be deliberately augmented by
causing other wrong not necessary for the commission.

CONTRARY TO LAW.

II. Direct Examination

Prosecutor: The victim herself, Magdalena "Maggie" de la Riva, your Honor.

Judge: Is she ready?

Prosecutor: Yes, your Honor.

Judge: Call your witness.

Prosecutor: May we call MS. "Maggie" de la Riva to come to the witness stand.

Court Interpreter: Raise your right hand. Do you swear or affirm to tell the truth, the whole truth and
nothing but the truth?

Witness: I DO.

Court Interpreter: State your personal circumstances.

Witness: I, Magdalena Dela Riva, 25 years old and single; and resides at No. 48, 12th Street, New Manila,
Quezon City

Prosecutor: We offer the testimony of the witness-complainant to prove that the accused committed the
crime upon his person. Ms. Witness, for the record, please state your name, status, educational
background, job, and residence.
Witness: I, Magdalena Dela Riva also known as Maggie De la Riva, 25 years old and single. I graduated
from high school in 1958 at Maryknoll College and finished the secretarial course in 1960 at St. Theresa's
College. I am a movie actress by profession and part of my work is to perform in radio broadcasts and
television shows. I currently reside at No. 48, 12th Street, New Manila, Quezon City.

Prosecutor: Ms. Maggie, do you know, JAIME JOSE, BASILIO PINEDA, JR. Alias "BOY," EDUARDO
AQUINO alias "EDDIE" and ROGELIO CAÑAL alias "ROGER," the principal accused in this case?

W: Yes, Sir/Maam, but I do not personally know them until the night they have pulled me out of my car
and raped me.

P: I see. Ms. Witness, what happened on the morning of June 26, 1967?

W: I was homeward bound from the ABS Studio on Roxas Blvd., Pasay City, driving my bantam car
accompanied by my maid Helen Calderon, who was also at the front seat. I was already near my
destination when a Pontiac two-door convertible car came abreast of my car and they tried to bump it.

P: Do you see the driver and the passengers of that car?

W: Yes, Sir/Maam. They were the accused.

P: And why do you think they try to bump your car?

D: Objection, your honor. It is only the opinion of the witness.

Judge: (Sustain or overrule; if overrule jump to witness continuing her narration, if sustained follow the
script)

P: Let me rephrase, your Honor. Did you do any act that would have cause them to try to bump your car?

W: None, Sir/Maam.
(if overruled: I don’t know why they did that, Sir/Maam)

P: I see. So what did you do after that?

W: I stepped on my brakes to avoid a collision, and then pressed on the gas and swerved my car to the left.

P: And what happened after?

W: The driver of the other car also accelerated his speed, and our cars almost collided for the second time.

P: Is the driver of that car in the courtroom right now?

W: Yes. It was him (points). He was the driver of the car.

P: What did you do?

W: I was annoyed and asked them, “Ano ba?”

P: What do the accused did thereafter?

W: He stopped the car which he was driving, jumped out of it and rushed towards me. I was so frightened
that I tooted the horn of my car continuously.
P: But this did not stop him?

W: No, Sir/Maam. He opened the door of my car and grabbed my left arm. I held on tenaciously to the
car's steering wheel and, both my maid and I screamed. He was able to pull me out of my car.

P: And what did your maid do after Pineda was able to pull you out?

W: My maid jumped out of the car and took hold of my right arm in an effort to free me. But he was able
to drag me toward the Pontiac convertible car, whose motor was all the while running.

P: And what happened when you were near the car?

W: Three men inside the car started to assist him: one of them held me by the neck, while the two others
held my arms and legs. All three pulled me inside the car.

P: And what did Accused Pineda did?

W: He jumped to the driver’s seat and sped away in the direction of Broadway Street.

P: Miss Maggie, what happened when you are already in the car?

W: I was made to sit between Jaime Jose and Edgardo Aquino at the back seat; Basilio Pineda, Jr. was at
the wheel, while Rogelio Cañal was seated beside him.

P: Did you speak to them?

W: Yes, I plead to them to release me.

P: And what was their reply?

W: There were only jeers, abusive and impolite language and they threatened me that they would
finish me with their Thompson and throw acid at my face if I did not keep quiet.
