That the co-affiant, Detective Christopher Meier #796 does depose and state that he is a sworn member of the State of Connecticut, Department of Emergency Services and Public Protection, Division of State Police, and has been a member of said department since May 2010. That co-affiant Meier is presently a detective assigned to the Central District Major Crime Squad and has been so for the past four (4) years and at all time mentioned hereinafter was acting in his official capacity as a member of said department. That the co-affiant Meier has received specialized training in the area of criminal investigations and that the facts and circumstances contained herein are related from personal knowledge and/or observations related to this co-affiant by other persons with personal knowledge of the incident described herein. 2. That the co-affiant, Detective Kevin Duggan #1115 does depose and state that he is a swom member of the State of Connecticut, Department of Emergency Services and Public Protection, Division of State Police, and has been a member of said department since November 2007. That co- affiant Duggan is presently a detective assigned to the Central District Major Crime Squad and has been so for the past three (3) years and at all time mentioned hereinafter was acting in his official capacity as a member af said department. That the co-affiant Duggan has received specialized training in the area of criminal investigations and that the facts and circumstances contained herein are related from personal knowledge and/or observations related to this co-affiant by other persons with personal knowledge of the incident described herein. 3. That on Tuesday, April 16, 2019, at approximately 0516 hours, the Connecticut State Police, Central District Major Crime Squad (CDMCS) was requested by the New Haven State's Attorney to investigate a police shooting involving Hamden Police Officer Devin Eaton and Yale University Police Officer Terrance Pollock. The incident occurred at the intersection of Argyle Street and Dixwell Avenue in New Haven. At this point in the investigation, CDMCS investigators have determined the foltowing series of events: 4. That on Tuesday, April 16, 2019, at approximately 0420 hours, Hamden Police Department dispatch personnel received an emergency 911 call from a cooperating witness (hereinafter referred to as CW1) at the Go On Gas Statian/White Stone Mini-Mart at 144 Arch Street in Hamden. CW1 reported that an African American male customer with dreads, driving a red car with license plate AK63322, and having a female passenger, pulled a gun outside of the gas station on the person who delivers the newspapers and asked him for money. CW/1 also said that the African American male was harassing a second customer too. CW1 reiterated the suspect and vehicle information and provided the direction of travel when the suspect left the gas station. 5. That two Hamden Police Officers were dispatched to a "Signal 27 at the Go On Gas 144 Arch Street, with possibly 128 used". (That a review of Hamden PO Radio Signals indicates that a Signal 27 is a Street Robbery and a Signal 128 is Weapon Involved - Firearm). Dispatch provided the vehicle description, registration plate, suspect description, and the information that there was a female in the vehicle; direction of travel was also broadcast. Dispatch later confirmed that the vehicle was a 1999 (This is page 2 of a 10 page Affidavit and Application.) That at 0424 hours, Hamden PD dispatch personne! notified New Haven PD via the "Hotline" that they “just had a street robbery happen in our town, was heading in your direction on Dixwell Avenue, with a gun used in a street robbery..." That Hamden dispatch personnel also correctly relayed the suspect description, vehicle description, and the fact that there was a female passenger in the car. (That information broadcast vial the "Hotline" can be heard by dispatch personnel in surrounding towns.) 7. That immediately thereafter, New Haven Police dispatch personnel notified their officers, via radio, (which is heard by Yale University Officers also) of the street robbery with a gun. They further provided their officers with the descriptive information. The only incorrect information broadcast to their officers was the license plate number, which the dispatcher reported as AK63233. (The correct license plate was AK63322,) 8. That at approximately 0427 hours, Yale University Police dispatch personnel notified their officers, via radio, af the information provided by New Haven PD. 9. That Hamden Police Officer Eaton, driving a marked Hamden Police SUV, drove south on Dixwell Avenue looking for the red Honda Civic. As he passed Argyle Street in New Haven, he observed a two-doar, red Honda Civic pulled partially into (front end in) a driveway on Argyle Street, Officer Baton tuned around on Dixwell Avenue and then turned right onto Argyle Street. Video surveillance obtained from the Believe-In-Me Empowerment Corp, located at the corner of Dixwell Avenue and Argyle Street, captured the incident and showed Yale University Officer Pollock pull onto Argyle Street just behind Officer Eaton, Officer Eaton pulled towards the driver side rear of the Honda, stopped his cruiser, then opened the daor of his cruiser and drew his handgun. The driver's door of the Honda opened and moments later Officer Eaton discharged his weapon in the direction of the driver/Honda. He moved around the back of the Honda to the passenger side where he continued to fire his weapon, As Officer Eaton was firing his weapon, Officer Pollock exited his cruiser, which was directly in front of the Honda, and began firing his weapon, Officer Pollock did not put his transmission in park and his cruiser rolled into the front end of the Honda. Additional officers arrived on scene approximately 1 minute later and removed both parties from the Honda. 10. That the front seat passenger and registered owner of the Honda Civic, Stephanie Washington (DOB 04/13/97), was struck by gunfire. Washington was transported to Yale New Haven Hospital where she underwent surgery for a norife threatening injury. 11. That the operator of the Honda Civic, Paul Witherspoon (DOB 08/08/97), was not injured in the incident and was taken into custody and placed in the back seat of a Hamden Police cruiser. No weapon/firearm was found on Witherspoon's person. 12. That CW1 was transported to the scene of the shooting by Hamden officers.
