AFFIDAVIT
I, JEROME ATUEL GONZAGA, Filipino, 21 years old, single, and a resident of
Montesunting Carmen, Bohol, Philippines, after having been duly sworn to in accordance
with law, do hereby depose and say:

1. THAT I am the boyfriend of the daughter of Analito B. Saren, herein respondent,

charged with Criminal Case No. 3763 for Direct Assault now pending before the
Municipal Circuit Trial Court of Carmen, Bohol;

2. THAT on December 11, 2017, around 11:00 in the morning, I rode in the patrol car
along with four police officers going to the respondent’s house, where I also live
with my girlfriend and son, in their hot pursuit operation against the respondent;

3. THAT upon arriving at our residence, the Police asked the respondent to step out
of the house and informing the same that a report was filed by his wife, to which
the respondent, with the door and windows locked, did not succumb to and
refused to go out, by saying “DILI KO MOGAWAS KAY WAKOY SALA”.

4. THAT the Police opened one window of the house, however the respondent
moved closer and closed the window while holding with him a “lagaraw” or
scythe;

5. THAT because of respondent’s refusal to the demand of the police, the latter
called for backup with the Chief of Police, and the same arrived in the area with
another Police Officer;

6. THAT the Chief of Police directed his officers to get pieces of wood and break
open the windows and door of our house;

7. THAT after breaking the windows and door open, PO2 Alberto Cabahug, from
the outside and through the opened window, shot the respondent who was in the
dining area, hitting his left gluteus and causing him to fall on the ground;

8. THAT it was only thereafter that the police officers entered the house and hand
cuffed the respondent. He was brought outside and photos of him were taken by
the Police;

9. THAT it was only thereafter that the police took him to the Cong. Toribio
Memorial Hospital in Carmen, Bohol for medical assistance;

10. THAT I execute this affidavit to attest to the truth of the foregoing and for
whatever purpose that this may serve.
 IN WITNESS WHEREOF, I have hereunto set my hand this 8th day of January 8,
