BEARING, CARRYING OR TRANSPORTING OF FIREARMS OR OTHER DEADLY
WEAPONS;

The aforesaid exemption was lifted from COMELEC Resolution No. 10446, otherwise known as “RULES
AND REGULATIONS ON (1) THE BAN ON BEARING, CARRYING OR TRANSPORTING OF
FIREARMS OR OTHER DEADLY WEAPONS AND (2) THE EMPLOYMENT, AVAILMENT OR
ENGAGEMENT OF THE SERVICES OF SECURITY PERSONNEL OF BODYGUARDS DURING
THE ELECTION PERDIOD OF THE MAY 13, 2019.

DEFINITION OF TERMS:

1. Commission - refers to the COMMISSION ON ELECTIONS

2. Committee on the Ban on Firearms and Security Personnel (CBFSP) - refers to the Committee on the
Commission of Elections, which shall be responsible for the implementation of the ban on the availment
or engagement of security personnel. It will exercise operational control and supervision over the
Regional Joint Security Control Centers (RRJSCCs) and the Provincial Joint Security Control (PJSCCs), as
well as any established City or Municipal Joint Security Control Centers (C/MJSCCs).

For purposes of the Mary 13,2019 National and Local Elections, it shall be composed of Commissioner Al.
A. Parreno, CBFSP Chairperson and COMELEC Representative, and one (1) Senior Officer of the AFP and
one(1) Senior Officer of the PNP, not lower than Officer Grade 07, Brigadier General or Chief
Superintendent, respectively, as Members.

The CBFSP has the sole and exclusive power to issue Certificates of Authority (CA) and shall be assisted
by a Secretariat composed of representatives from the Commission, AFP and the PNP. The Secretariat
shall be headed by a Senior Officer of the Commission.

3. Election Period- refers to the election period prescribed in COMELEC Resolution no. 10429, which is
from January 13, 2019 up to June 12, 2019.

APPLICABLE PROVISIONS:

RULE III – AUTHORITY TO BEAR, CARRY OR TRANSPORT FIREARMS OR OTHER DEADLY


WEAPONS

SECTIONS 6. Who may bear, carry or transport firearms or deadly weapons. Only the following persons
may be authorized to bear, carry or transport Firearms or other Deadly Weapons during the Election
Period:
(L) Other qualified individuals, who by the nature of their official duties, profession, business or
occupation, such as but not limited to cashiers, disbursement officers, persons who are under
Witness Protection Program, etc. are considered as high risk individuals (HRI); Provided, that,
in addition to those provided for by this Resolution, the following documents must be included
in their application:

i. Threat assessment issued and certified by the Chief of Police, PNP


Provincial Director or PNP Regional Director having jurisdiction of the area where the
applicant is a resident, and duly verified by the Directorate for Intelligence of the PNP;

ii. Endorsement coming from the Chief, Philippine National Police that the
applicant is considered high risk;

iii. In cashiers/disbursing officers:

1. Certificate of employment stating that he/she is currently employed


under the conditions stated in his application; and

2. Other pertinent documents such as but not limited to financial


statements, ITR of the Company/ Employer;

iv. in possession of valid License to Own and Possess firearms, Permit to


Carry Firearms Outside Residence; and other applicable firearms licenses;

Section 7. Application for authority to bear, carry or transport Firearms or Deadly Weapons-
Applications for the issuance of the authority to bear, carry or transport firearms or deadly weapons shall
start on December 01, 2019 and end on May 29, 2019. All applications shall include:

e. For other qualified individuals, who by the nature of their official duties, profession, business or
occupation, such as but not limited to cashiers, disbursement officers, persons who are under Witness
Protection Program, etc. are considered as high risk individuals (HRI) provided under Section 6,
paragraph L of Rule III:

1. Duly accomplished and completely filled-up CBFSP Form No. 2019-01C (available at the CBFSP Office,
COMELEC Main Office) in three (3) copies with CD; signed by the applicant cashier or disbursing officer,
indicating therein, among others, his full name and the office where he is employed or connected;

2. 3 pieces 2x2 photograph of the applicant attached to the application forms;

3. Certification of the employer under oath that the applicant is an employee of the company and
designated as cashier or disbursing officer;

4. Certified true copy of applicant’s latest ITR;

5. Certified true copy of employer’s latest ITR;


6. Description of and proof that the nature of his official duties, profession, business or occupation
requires him to carry large sums of money or valuables;

7. Duly accomplished Form 19A-10C with the firearms description and registration data, including the
LCR with MO/LO for government issued firearms and/or the CFR with PTCFOR, for privately owned
firearms;

8. Copies of the abovementioned licenses and certificates;

9. Certification under oath by the applicant that all the information in the application are true and correct;

10. Copy of the Official Receipt to prove payment of the filing fee in the amount of Five Hundred Pesos
(php500.00)

Section 8. Who may submit the applications/requirements for the authority to bear, carry or transport
Firearms or Deadly Weapons- The following are authorized to submit the duly accomplished application
forma and other requirements of an applicant for authority to bear, carry or transport Firearms or Deadly
Weapons during Election Period:

d. For other qualified individuals mentioned under Section 6, paragraph (L), of Rule III, the Individual or
his duly authorized representative with proper authorization and photocopies of valid identification
cards of the principal and the representative.
