Guideline for Flat Transfer (Individual to Individual).

This Checklist is issued to help members in smooth transfer/sale of their Flat or shops. The actual documentation requirements may vary on
cases to case basis. Please check with society office if any further documentation/s is required than mentioned below.

1. Written Application stating intend of selling flat / shop by the flat / shop owner (Member/s), the
application also to include his / her date of owning the flat/shop & Transferees name. In case
there are joint holders of flat / shop, all such holders to sign all the documents while submitting to
society. NOTE: Members can sell flat /shop only after 1year from inclusion of their name in
Society records. i.e: One year from date as mentioned in CIDCO Final Order Letter stating
inclusion of members name in of Society.
2. Member should have cleared all maintenance & others dues as per Society Records.
3. Submission of Original Agreement Copy (for verification only) and “No Objection” or Loan
Clearance certificate by Financial Institute (in case of Loan availed for Flat/ Shop)
4. Cheque addressed to Society credited in Society Bank
Account
5. ‘No Due Certificate’ will be issued on written request as under~
a. No Dues Certificate should be issued within 7days of crediting of Cheque (Pt#4) in
society bank account & completion of Pt#1, 2 & 3 or in case of rejection will be
communicated within 7 days of decision of Committee if any ineligibility under section
29(2) a & b of Act.
b. No Dues with No objection for sale Certificate should be issued after crediting of
Cheque (Pt#4) in society bank account & completion of Pt#1, 2, 3, 6i, 6ii, 6iii, 6iv, 6v & 6vi
and within 7days of Managing Committee meeting or in case of Rejection will be
communicated within 7 days of decision of Committee if any ineligibility under section
29(2) a & b of Act.
6. No Objection Certificate (NOC) to Transfer Flat / Shop for CIDCO Estate Manage shall be
issued only if all the following are fully complied
i. Resignation of Original Member in prescribed Form. (Appendix-13)
ii. Consent of the Proposed Transferee for transfer of shares and interest of Transferor
(Seller) to Transferee (Buyer) (Appendix 20(2))
iii. Notice of intention of a member to transfer his/her Shares and Interest in the
Capital/Property of the Society (Appendix- 20(1))
iv. Form of Application for Transfer of Share (Appendix 21)
v. Surrendering of Original Share Certification (Mandatory)
vi. Undertaking about the Registration of the Transfer of a Flat under Section 269AB of the
Income- Tax Act jointly by the Transferor and the Transferee if the consideration for the
transfer is Rs.75,00,000/- or more (Appendix 25(1))
vii. Incoming Member ID proof (Ration card/ Passport/Voter Card) & PAN Card photocopy
viii. Certified True Copy of stamp duty paid Sale of Agreement
ix. Payment of Entrance Fees of Rs 100/-
7. Inclusion of Incoming Members name in Society Member list & Share Certificate will be done
only when all the following are submitted

a. Certified photocopy of Final CIDCO Membership inclusion Letter
b. Submission of Certified photocopy of Paid CIDCO Transfer fees
c. Form of application for Membership of society by Proposed Transferee (Appendix 23)
d. Nomination Form to be furnished in Triplicate (Appendix 14)
e. Form of application for Permission to hold more than one flat (if applicable) (Appendix 30)
8. Bank Mortgage NOC to issued only on completion of above steps 7a, 7b, 7c, 7d (if applicable)
for inclusion of incoming members name in Society Records & submitting a Photocopy of Bank
Loan Application or Sanction Letter
9. Member Name in Society records:
a. Till Certified photocopy of Final CIDCO Membership inclusion Letter is not submitted the
Transferor’s (old Member) name shall be mentioned in all transaction including Bills,
Receipts, Letters, etc
10. In case member wishes to nominate any other person to act on his or her behalf, a proper
Notarized Power of attorney (POA) in original has to be submitted with Society Office. The
POA should clearly mention the level of POA given to the person.
11. Members are requested not to put unnecessary pressure for completing or accelerating
issuing NOC or bypassing any society rules. All the above timelines are to be considered
by member while they are considering any transactions.
12. In some cases to protect the society interest secretary or any committee member may
request for legal opinion from society legal advisor to proceed further.
13. In such cases legal advisor’s opinion will be final.
14. The above timelines are applicable in case of clear & complete documentation. Society or
Committee members will not be responsible for any situation or delay due to incomplete
or improper documents or any losses arising out of above timelines or Requirements
