As per your instruction and the request of the party I have made scrutiny of the
documents sent by you and I have given my opinion regarding the competency of
Sri,Basappa S/o Siddappa Bomraddi R/o Yalagi to execute a valid SIMPLE
REGISTERED MORTGAGE in favor of your Bank in respect of the proposed property
the agriculture land bearing Sy.No. 155/D admeasuring 07 acres 20 guntas with land
revenue assessment of Rs.10-40Ps situated at village Yalagi Tq.,Shorapur.
I am herewith returning all the documents sent by you, please acknowledge the
receipt of the same.

The agriculture land bearing Sy.No. 155/D, admeasuring 07 acres 20 guntas with
land revenue assessment of Rs.10-40Ps situated at village Yalagi Tq.,Shorapur.
Boundaries:-
East :- Road
West :- Basavaraja
North :- Basappa

1. Pahani Patrikas :-
The entries in these documents go to show that since the year 2001-02 to till date
the intending borrower Sri,Basappa S/o Siddappa Bomraddi is the owner and
possessor of the land bearing Sy.No.155/D, admeasuring 07 acres 20 guntas
situated at village Yalagi Tq.,Shorapur. Since then the mutation to till date
Sri,Basappa is in continuous possession and enjoyment of the said land as its
owner and possessor. Further the entries go to show that Sri,Basappa has
perfected her title upon the said land by being in possession of it for more than
17 years continuously. The entries in column No. 10 of the pahani patriks go to
show that the land is ancestral properties as it has been mentioned as ‘Pattedar’
in that column.
2. Lavani Patrikas:-
This document goes to show that Sri,Basappa S/o Siddappa Bomraddi is the
present absolute owner and possessor of the land bearing Sy.No. 155/D,
admeasuring 07 acres 20 guntas with land revenue assessment of Rs.10-40Ps
situated at village Yalagi Tq.,Shorapur.
The no dues certificate issued by the Tahsildhar Shorapur goes to shows that
there are no land revenue arrears is pending or any government dues in respect
of the lands Sy, No. 155/D, situated at village Yalagi Tq.Shorapur.
goes to shows that Sri,Basappa has not taken any loans from the said banks by
mortgaging the said land and there no dues with these banks in his name
4. No Tenancy Certificate:-
The no tenancy certificate issued by the Tahsildar Shorapur goes to show that
the land Sy, No. 155/D, situated at village Yalagi Tq.Shorapur is not tenanted
land and nobody has filed form No. 7 claiming occupancy rights over the said
land.
5. Encumbrance Certificate:-
The encumbrance Certificate No. 1733/18-19 dated 10-08-2018 for a period from
01-04-2006 to 08-08-2018 issued by the Sub Register Office Shorapur goes to show
that no transaction has taken place in respect of the land bearing Sy.No. 155/D, to
the extent of 07-20 guntas situated at village Yalagi Tq.,Shorapur. It also goes to
show that Sri,Basappa has not mortgaged the said land with any Bank OR
financial institution. It further goes to show that the said land is free from all
kinds of encumbrances.
From the contents of the mutation register and the entries in the pahani patriks it
appears that Sri,Basappa is in continuous possession and enjoyment of the said
land from the date of mutation in his name.
7. Certificate of Title:-
a) Whether the party has an absolute, clear and marketable title over the
property?

In view of discussions made in the above pares and after perusal of the earlier
mentioned documents I am of the opinion that Sri,Basappa S/o Siddappa
Bomraddi has got absolute, clear and marketable title over the land bearing
Sy.No. 155/D, admeasuring 07 acres 20 guntas situated at village Yalagi
Tq.,Shorapur. He is competent to execute a valid simple registered mortgage in
favour of the bank. The simple mortgage is to be created by the execution of a
registered mortgage deed.

I have gone through the original title deed intended to be deposited relating
to the property and offered as security by way of Simple/Equitable mortgage
and that the said documents of title referred to above are evidence of the title and
that if the said documents of title are deposited for Simple/Equitable mortgage

6. The mortgage if coasted will be available to the bank for the liability of the
intending borrower Sri,Basappa.
7. I further certify that Sri,Basappa has got valid and marketable title in the
properties shown above. And he can Create SIMPLE registered mortgage
in favor of CANARA BANK BRANCH Kembhavi.

Register Office concerned and no encumbrances on the property that would adversely affect the Bank are found.
I confirm and certify that the above information is true and correct as per records maintained at the above offices.

AFFIDAVIT
2. That I have offered the properties fully described in the schedule annexed
hereto situated at village Yalagi Tq., Shorapur as security for the aforesaid
loan facilities.
3. That I am owner of the property with possession and I have absolute rights
and powers for mortgaging the property.
4. That the property belongs to our joint family and I have offered the property
as scrutiny to the bank with the consent of all Co-partners in my family. I
have been authorized by the other co-Partners/Joint owners/Joint family
members to create the mortgage in favour of the bank.
6. That the property is free from all encumbrances, charges etc., and there are no
dues payable to any statutory authorities or other in respect of this property.
No taxes or levies or fees are payable to any Municipal or other statutory
authorities in respect of this property.
7. That the property is not the subject matter of any agreement of sale or other
agreements or attachment or injunction from any court of statutory
authorities.
10. That no land acquisition proceedings are initiated by any authority, either
judicial or statutory in respect of this property. No tenancy rights have been
created on this property.

11. That I have complied with all the requirements including the requirements
under the Urban Land Ceiling Act for creating mortgage in favour of the
Bank.
12. That after creating the mortgage in favour of the Bank, I shall not create any
further encumbrances or charges of whatsoever nature on the property. The
property shall be held by me and no interest of whatsoever nature shall be
created in the property in favour of any third party until the Bank’s charge is
discharged.nbn b
13. That I have offered the mortgage of this property in favour of the Bank after
convincing the Bank that the property is free from all encumbrances, and I
have full authority and right to create this mortgage to secure the credit
facilities and I have complied with all legal formalities. I am fully aware that
I am responsible for all civil and criminal consequences in case of miss
representation to the bank.
