Positive Lettings Ltd – Tenancy Application Summary

(ALL tenants over 18 MUST complete applicant details)

UNLESS NOTED IN SPECIAL CLAUSES WITHIN GOODLORD, THE TENANT AGREES TO RENT THE PROPERTY IN THE
CONDITION AS SEEN.

Important Information for Applicants

This is not a Tenancy Agreement and the terms and conditions set out below are surrounding the agreed terms on which this property
is initially agreed to you. All tenancies are subject to satisfactory references and final landlord approval.

References (a credit check, employer reference and previous landlord reference) will be required for you and your guarantor (should
you require one) as we can only agree to a tenancy subject to satisfactory replies from those referees. Our investigations will also
include a search of the credit registers to establish your financial status and credibility.

Initially we require an administration fee in cleared funds, to enable us to withdraw the property from the market and hold it in
your name until administration formalities are completed. Once the referencing has been completed this money will be
deducted from the initial monies due at the beginning of the tenancy. If for any reason, you fail the referencing or credit checks
these monies will not be refunded. Failure to disclose information beforehand may lead to failing the reference process.
We cannot allow access to the property before all tenants have signed the Tenancy Agreement in our office, and all moving in
money is paid in cleared funds. This can be paid by cash, bankers draft, debit card.
If the tenant withdraws from their application (for any reason), the holding fee will be held by the Agent (to cover for costs
incurred) or until a replacement has been found, however if the tenancy has passed the original commencement date and the
tenant is still not replaced the administration fee will be held as loss of rent, if any, but refundable in full, should the landlord
withdraw in any way and where the prospective tenant is not at fault.
The landlord grants the tenancy of the property to the named tenant(s) upon the understanding that the landlord or his agents
are not responsible for insuring the tenant’s personal possessions or for providing insurance for the tenant to cover against
accidental damage caused by the tenant to the landlords’ furniture, fixtures and fittings at the property. It is strongly advised
that the tenant take out adequate Insurance to protect his interest in this respect. Details of suitable cover are available from
the Agent.
Please be aware that keys for the property will not be released until 10:30 am on the tenancy start date, this can not be
changed.
Tenants must be aware that they are to be solely responsible for any Gas, Electricity, Telephone Bills and Water & Sewage
rates during the duration of the tenancy unless otherwise agreed. The tenants are fully aware and fully understand by law that
they are solely responsible for the Council Tax or any replacement or re-enactment thereof and the landlord or the landlords'
agents are in no way responsible for payment of any bills arising.
At the end of the Tenancy all keys are to be handed into our office by midday, if the keys are not handed in on the last day of
the contract (tenancy) then the locks will be changed at your expense.
All tenants will be jointly and severally liable for the tenancy, this includes the upkeep of the property and payment of rent on
the rent due date.

READ CAREFULLY: As a prospective Tenant I/We acknowledge:

That the ‘Holding Deposit’ may not be returned in full and maybe forfeited as a contribution towards the Agencies cancellation
costs and the Landlords lost rent. If I/We should withdraw from taking the proposed tenancy (on the terms set out in this
document) or if I/We should deliberately give the Agents any knowingly misleading or intcorrect information then I/We accept
that I/We will not be refunded the Deposit in Full (if any).
that this provisional letting is not guaranteed at this point, but that the Agents will advise me as to whether or not the proposed
letting is confirmed if I/we contact them no later than mid-day three days prior to the commencement of the tenancy where
practical but in any event, unless specifically agreed otherwise in writing by the Agents, this letting will not proceed until
satisfactory replies to reference enquiries are in the Agents Office and satisfactory.
All referencing forms need to be completed within 3 working days of receipt. Failure to do so could result in loss of
administration fees and the property remaining on the market for let.
STUDENTS: You will require a guarantor if you wish to let a property through positive sales and lettings. You and your
guarantor have 7 days from receipt of referencing forms to complete the information. Failure to do so could result in loss of
administration fees and the property remaining on the market for let.
Guarantors – it is the responsibility of the tenant to ensure their guarantor completes the referencing form in the time stated
above. Failure to do so could result in loss of administration fees and the property remaining on the market for let.
That I/we understand there will be a charge of £50 (exclusive of VAT) for the necessary administration (References) should my
tenancy be extended
That I/we have deposited the sum (next page) with Positive Lettings Ltd (the Agents) as a Deposit on the property (next page).
I understand the agents act on behalf of the Landlord and cannot be accountable for his/her decisions.
That I/We agree that all my future rent payments will be made by standing order (direct from your bank). A charge can be

levied (charged) for rental payments made in any other manner.
That should I/we continue with my proposed letting the rent account will be payable on the date noted on the Tenancy
Agreement (‘due date’). Should the Agents have to send any rent overdue reminders during my occupancy of the premises I
/we understand that an Administration charge of £20 (exclusive of VAT) per reminder will be made to Positive Lettings Ltd.
That the agent does not hold cash in the office, should a refund of any monies be appropriate, under no circumstances will
cash be paid. I accept that this refund may be returned using a company cheque.
Please note we provide a third party ‘Just Move In’ your contact details as they will register your utilities for you. Any additional
services for your property can also be organised for you.

Please Note that False or Misleading information will jeopardise your Application. Positive Lettings Ltd Reserve the right to
refuse any application. All tenants must sign the Tenancy Agreement (contract) before possession can be legally given. No
keys will be given until all signatures are on the Tenancy Agreement. Signing this agreement confirms that you have read and
agreed to the ‘Important information for Applicants’ on Page 2.

Failure to email or verbally disclose any outstanding CCJ's or Bankruptcy orders before admin fees have been paid may
result in cancellation of tenancy offer and loss of fees.
