RAMOS vs. TOPSTAR

For Ulysses Ramos (deceased), Marife Ramos and their children Eulariza
Ramos, Eugene Ramos and Eurico Ramos:

Valera, Alexander

Ulysses Ramos, 35 together with his wife Marife Ramos, 34, and their children
Eulariza, 12; Eugene, 8, and Eurico, 5 were traversing Mindanao Avenue to go to
a grocery store aboard their family car, Honda Brio with license plate AOA 3301
on August 15, 2017 (Tuesday) when a 10-wheeler cement mixer truck driven by
a Jason Muleta, employee of Topstar Mix Ready Concrete landed on the said
vehicle when it hit the center island and landed.

This resulted to the instant death of the driver Ulysses Ramos and severe injuries
to Marife, Eulariza, Eugene and Eurico.

According to the driver, Jason Muleta when interviewed, he was driving in a


normal speed but the 10-wheeler truck lost its break and despite his repeated
attempt to stop the car, he had to choice but to hit the center island to avoid
hurting more people.

However, according to the narration of Marife, the 10-wheeler truck was


approaching in a faster than normal speed which is the reason why when it hit
the center island instead of stopping the vehicle, it skidded and rolled over in the
Brio instead.

Marife and her children and in behalf of her deceased husband now assails that
the lack of proper maintenance and due diligence of the owner of the 10-wheeler
truck, Topstar Mix Concrete Cement caused, if not contributed to the incident that
lead to the death of Ulysses and their severe injuries. Ulysses is the breadwinner
of the family while Marife tends to the household and their children. They now
suffer great loss and comes to the court for redress. They contend that as the
owner, Topstar Mix Concrete cement is liable and thus files an action for
damages against the said company.
