This contract of employment is entered into this _________ day of _____________, 20 _____
by:
MOED MARKETING, a corporation duly organized and existing in accordance with laws of
the Republic of the Philippines, with principal office at 4th Floor, Room H, Royal Crowne
Plaza, Katipunan Street,Labangon, Cebu City, represented in this act by its
president,________________________, hereinafter referred to as the EMPLOYER
--------AND--------
Leoni Francis Lagrama, of legal age, Filipino, and is a resident of 214 Tagaytay Vito,
Minglanilla Cebu, hereinafter referred to as the EMPLOYEE.
Witnesseth:
WHEREAS, the employee manifests and guarantees that he possess the requisite qualities and
competencies needed by the Employer in the conduct and course of its business.
1. APPOINTMENT
Employee is hereby appointed as (Job Position) under a probationary status of six (6) months,
including one (1) month training reckoned from his first day of actual report for work
which will be on (date)
2. COMPENSATION
2.1 Employee will receive a basic monthly salary of (amount in words and enclosed figures)
subject to government mandated deductions to be borne by the Employee. In addition, Employer
will pay the mandatory 13th month pay at the end of each year.
2.2 Employee is also entitled to receive attendance incentive of Two Thousand Pesos (Php
2,000.00) per month.
2.3. Employee is likewise entitled to a 17% commission on the total sales income as reported
and verified by the Finance Department.
2.4 Employee is entitled to a night differential for every hours worked between 9 PM and 5
AM inclusive which is equivalent to 10% of his hourly rate.
3. BENEFITS
3.1 Reckoning from his first day of actual work, the employee shall enjoy 1.5 days vacation
leave and 1 day sick leave, which shall accumulate every month thereafter. Remaining
leaves of whatever kind shall be convertible to cash at the end of the year or at the end of
employee’s tenure of service to the company, whichever is applicable.
3.2 Reckoning from his first day of actual work, the employee shall enjoy health care services
that includes dental coverage and hospitalization, due to natural illness or accident,
provided that such hospitalization shall not exceed seven (7) days, otherwise, the Employer
shall not be liable to cover for the expenses incurred on the exceeding days.
3.3 Reckoning from his first day of regularization, the benefit enjoyed by the employee in the
immediately preceding section shall extend to one of his dependents of his choice.
3.4 Employee shall be paid on holidays, vacation leaves and sick leaves an amount equal to
his daily rate.
3.5 Work rendered during holidays shall be paid in accordance with the statutory rate
provided by law.
4. OVERTIME WORK
Being part of the management level, employee is not entitled to overtime work pay. However,
meal allowances shall be provided.
5. HOURS OF WORK
Employee shall render at least eight (8) hours of work every day and report at least five
times a week. It is however understood that the employee is employed with a level of
confidence and degree of responsibility that may require him to render work beyond normal
business hours.
Employee shall abide with policies on decorum, proper conduct, confidentiality and other
company rules and regulations stipulated in the company handbook.
7. TERMINATION
Employer reserves the right to terminate and cancel this contract after observing due process for
just or valid causes. Termination may be due to any, but not necessarily limited to the following:
a. Breach of Confidentiality
b. Conflict of Interest
8. RESIGNATION
Prior to the expiration of this contract, the employee has the option to discontinue his service
to the company, provided that a written notice is filed within thirty (30) days before his last
day of employment and provided further that such notice is duly received, acknowledged
and accepted by the employer.
IN WITNESS WHEREOF, we have set our hands this 21st of August 2017 at Colon, Cebu City
Philippines.
