MOTION TO DISMISS

WITH ALL DUE RESPECT TO THE HONORABLE COURT, plaintiff through

counsel, most respectfully manifest:

1. That the defendants filed a verified complaint before this Honorable Court

sometime July 17, 2002;

2. That the defendant s filed their answer and latter, the same defendants through counsel filed

their Motion to Dismiss, dated September 13, 2002;

3. That the Honorable Court set the hearing on the motion sometime January 21,

2003;

4. That on the set hearing both counsel and the parties agree to refer back the

said instant case to the Punong Barangay for earnest effort to amicably settle

the case;

5. That an order was issued by the Honorable Court dated January 21, 2003 and

ordered the first Barangay Councilman to try to amicably settle the dispute;

6. That in Compliance with the Order of the Honorable Court, the first Barangay

Councilman of Barangay Baguinge, Kiangan, Ifugao called both parties

together and was able to arrive at an Amicable Settlement dated February 21,
2003. A Xerox copy of said Amicable Settlement is hereto attached as

ANNEX “A”;

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Court to issue a judgment on the Amicable Settlement entered into by

both parties before the Office of the Barangay Captain, Baguinge, Kiangan,

Ifugao.
