I, Sharmila W/o A.S.Sivakumar, Hindu, Indian, aged about 37 years,

residing at No: 1, Kuppusami Street, Sundarambal Nagar, Tambaram
Sanitorium, Chennai-45 do hereby solemnly affirm and sincerely state on
oath as follows;
1. I am the petitioner herein and plaintiff in this case. I know the
fact of this case.
2. I have filed the above suit against the defendants for the relief
of permanent injunction and other reliefs. In the said suit the defendant had
appeared and had filed a written statement and the above case was posted for
trial. During the pendency of the above suit the 1st defendant herein died on
08.08.2017 leaving behind the 2nd defendant and his daughters as his legal
heirs. They are proper and necessary party in the above suit for binding
adjudication. Hence I am advised to file this application to implead the legal
heirs of 1st defendant.
4. Unless this petition is allowed, I will be put to great loss and
hardships.
It is therefore prayed that this Hon’ble Court may be pleased to
implead the petition mentioned persons as legal heirs of the 1st defendant
and thus render justice.

adjudication. In the said process there has been delay in impleading the legal
heirs. Hence I am advised to file this application to set aside the order of
abatement if any passed against the 1st defendant. I have already filed
separate application to condone the delay in and on impleading the legal
heirs of 1st defendant and to set aside the order of abetment if any.
4. Unless this petition is allowed, I will be put to great loss and
hardships. My reason is bonafide.

aside the order of abatement if any passed against the deceased the 1st
defendant and thus render justice.

1st defendant.
