A: Wherefore Defendant is ordered to pay Plaintiff the sum of 300,000.00 plus


legal interest.

Q: Is it alright for the court to state “To pay the principal loan of 300th plus legal
interest from the time the case is filed rendered by the MTC?

A: Yes

Q: Would it not be beyond the Jurisdictional amount that an MTC can award?

A: No, it will not be beyond the jurisdiction of MTC. For what was original
awarded by the MTC is still within it’s jurisdiction and the award for legal interest
is merely an incidental expense arising out of a collection for sum of money case,
or it is merely a consequential cost.

Q: Is a real action capable of pecuniary estimation?

A: yes, in terms of jurisdictional amount.

Q: is the rule absolute that a real action is capable of pecuniary estimation?

A: No the rule is not absolute. If the interest to the title is merely incidental.
