The undersigned Detective Kenneth Catino being duly sworn does depose and state that he is @ member of the Milford Police Department since April 11, 2003 and at all times mentioned herein was acting as a member of said department. The following facts and circumstances are stated from personal knowledge and observations as well as from information received from other police officers acting in their official capacities and from statements made by prudent and credible witnesses. 2. That on May 19, 2019, at about 10:01 p.m. Milford Police officers were sent to 583 Anderson Avenue, Milford, Connecticut, on a report of a man in need of medical assistance. It was learned that the male in need of medical assistance was identified as Christopher Peckham, age 80, who resides at 583 Anderson Avenue, Milford, Connecticut. Responding police learned from Milford Fire Department personnel that the male in need of medical attention, Christopher Peckham, had expired at the scene. It was learned that Milford Fire Department Paramedic Kevin Frank pronounced Christopher Peckham dead at approximately 10:10 p.m. on Sunday, May 19, 2019. A preliminary exterior examination of the decedent showed numerous and significant injuries to his facial area consistent with his being assaulted in some manner. 3. That investigating detectives learned during the course of the investigation that the decedent was assaulted by another resident of 583 Anderson Avenue, Milford, Connecticut, identified as RICKY GARCIA. According to Jacqueline Peckham, the decedent's sister, asked RICKY GARCIA to remove her brother (Christopher Peckham) from her bedroom and that is when the assault took place. After the assault, RICKY GARCIA dragged Christopher Peckham out of the residence to a point at the base of the ramp that leads from the kitchen door to the yard. This is approximately the same location where the decedent was located when authorities were called to the scene. Upon arrival at police headquarters, RICKY GARCIA accompanied Affiant Catino and Det. Broderick to an interview room. At no time during this interview was RICKY GARCIA in custody as the door to the interview room remained open. RICKY GARCIA was cooperative and voluntarily consented to being interviewed. RICKY GARCIA stated that earlier in { the afternoon Jackie Peckham called him for help. Jackie Peckham asked him if he would get Chris Peckham out of her room. He stated he started “roughhousing” with Chris Peckham inside of Jackie Peckham's room, He stated he slapped Chris Peckham in the face and was trying to wake him up. He described Chris Peckham as dead weight and would not respond. At that time he stated he left the room and went back outside. He further explained he did not know how Chris Peckham got outside and he did not bring him down the ramp. He then recalled that Victor Berrios helped him drag Christopher Peckham out of the room by his feet. He stated they put Chris Peckham on the ramp and walked away. After further questioning him about the altercation that occurred inside of Jackie Peckham's bedroom, he stated he dropped his foot on him (Chris Peckham) in the mid-section and it “went like jelly on him”. RICKY GARCIA stated throughout the interview that he recalled kicking Chris Peckham no more than two times, and not punching him. RICKY GARCIA then stated that he sustained no injuries and “I stomped him.” RICKY GARCIA stated that “he (Chris Peckham) was kicking at me and | dropped the hammer on him." He explained that this is what it's called when you bring the foot down on somebody. Affiant Catino and Det. Broderick concluded the interview with RICKY GARCIA and drove him back to his residence at Anderson Avenue at his request. 5. That Detective Sergeant Douglass Youd, of the Milford Police Department, conducted a follow-up interview of Jacqueline Peckham and she indicates, among other things, the following in a sworn statement. She indicated her brother, Christopher Peckham, was passed out on her bedroom floor. She asked RICKY GARCIA to remove her brother from her bedroom and put him in the kitchen. She indicated that RICKY GARCIA started kicking her brother many times and she indicated it was up to fifty mes. Jacqueline Peckham said she saw RICKY GARCIA do this while she was lying on her bed and her brother was lying on the floor next to her bed. She further indicated that RICKY GARCIA then dragged her brother outside of the residence and left him on the ramp from the back door. Jacqueline Peckham says she has known RICKY GARCIA for about 20 years and described him as a white male, about 58 years old, with a medium build, with short salt and pepper hair. She further said he limps because he has bad feet. Jacqueline Peckham said that RICKY GARCIA lives at 683 Anderson Avenue, Milford, Connecticut. Jacqueline Peckham could not be specific with investigators in terms of when this assault on her brother took place, other than to say it was sometime Sunday, (May 19, 2019) while it was still light outside. Jacqueline Peckham said that RICKY GARCIA had a long sleeve white shirt on with jeans and he was also wearing sneakers at the time of this incident. She indicated that as RICKY GARCIA was assaulting her brother, he was saying “Get the fuck out’. Jacqueline Peckham said her brother was not speaking during the assault, as best she can remember. When RICKY GARCIA stopped assaulting Christopher Peckham, Jacqueline said that he dragged him from her room to a point outside the back door on the walkway ramp. She said that her brother was dragged from her room by the legs. Jacqueline Peckham stated that when she got out of bed she eventually made her way to the kitchen where she saw her brother lying on the ramp that leads from the back yard into the kitchen. She further stated that RICKY GARCIA and her brother, Christopher Peckham, were constantly fighting over things that she really couldn't specify. Jacqueline Peckham was specifically asked if other people were present during this assault and she indicated there were not. 6. That Detective Sergeant Douglass Youd conducted a follow-up interview of Victor Berrios. He indicated, among other things, the following in a sworn statement. He was asleep in his room at 583 Anderson Avenue, Milford, when the male living in the room next to him, Tim Duhaime, told him that RICKY GARCIA was “beating up" Christopher Peckham in Jackie's (Jacqueline Peckham's) room. He continues saying he went down to check on Jacqueline Peckham and he saw RICKY GARCIA hitting and kicking Christopher Peckham. He said he saw RICKY GARCIA punching Christopher Peckham in the chest and legs, further saying he saw RICKY GARCIA jump up and land with his two legs on Christopher Peckham's stomach. Victor Berrios stated that he heard Jacquelin Peckham ask RICKY GARCIA to take her brother out of her bedroom. Victor Berrios said he saw RICKY GARCIA try to drag Christopher Peckham out of the room at which time he helped RICKY GARCIA drag Christopher Peckham out of the room, through the kitchen, and out the back door leaving him. Victor Berrios says that he knows RICKY GARCIA, but only as another person who resides at 583 Anderson Avenue in Milford. Victor Berrios says that when he first saw Christopher Peckham lying in Jacqueline Peckham's bedroom, he was lying on the floor between a chair and closet in this room. He stated that he heard Christopher Peckham say to RICKY GARCIA, *Stop hitting me” as GARCIA was assaulting him, He further stated that he heard RICKY GARCIA say to Christopher Peckham, “Useless piece of shit. You need to get out of the house. Victor Berrios restated that he saw RICKY GARCIA punch Christopher Peckham many times, as well as kick him a lot. He said he saw Christopher Peckham being punched in his chest, stomach, on his legs and his knees. Victor Barrios says that he noticed that Christopher Peckham did not try to defend himself while this assault was taking place. Victor Berrios says that RICKY GARCIA dragged Christopher Peckham by his arms as he pushed Peckham's legs as they were dragging him from the room. As this was taking place, Victor Berrios was telling RICKY GARCIA to leave him alone. He further stated that after he was dragged onto the ramp, Christopher Peckham was lying face up and he was still awake at that time because he was mumbling and talking to himself.
