• This contract would be applicable exclusively in the city/state of KOLKATA/WEST BENGAL.
• The contract amount of Rs.1661/- will be payable in advance either by Cash/Cheque/Pay Order/Demand draft
favouring Johnson Controls-Hitachi Air conditioning India Limited.
• Receipt for maintenance of service contract will be issued separately and will be valid subject to realization of
the amount.
• In case of dishonour of cheque, receipt issued t along with the above maintenance contract will be void abinitio.

Terms & Conditions for Split and Window Air Conditioner:


1. The Company shall provide three types as Maintenance Contract Services viz (i) Preventive Maintenance (ii)
Semi Comprehensive (iii) Comprehensive Services as may be opted by the Customer.
PREVENTIVE
The routine servicing will cover the following:
•Checking operational performance parameters of Machine.
•Cleaning of blower, Condenser fan, Air filter, Evaporator coil, Condenser Coil & parts.
•Any extra Services other than what is mentioned in the contract would be on Chargeable basis.
SEMI-COMPREHENSIVE
Services mentioned in Preventive contract are covered under this contract other than that in case of repairs or
replacement following components are covered under this contract:
(a) Fan Motor (b) Louver Motor (c) Gas Charging (d) Capacitors & Relay (e) Thermostat Switch (f) Selector
Switch. (g) Air Filter (h) Remote Control (i) Fan & Blower (j) PCB & Controller
The components other than those mentioned above like Sheet Metal Parts, Evaporator Coil, Condenser coil &
plastic components such as front grill “D” Block, Air Deflectors, louvers, etc, are excluded from the scope of this
contract.
COMPREHENSIVE
Services mentioned in Semi Comprehensive contract are covered under this contract other than that in case of
repairs or replacement following components are covered under this contract:
(a) Fan Motor (b) Louver Motor (c) Gas Charging (d) Capacitors & Relay (e) Thermostat Switch (f) Selector
Switch (g) Air Filter (h) Remote Control (i) Fan & Blower (j) PCB & Controller (k) Compressor
The components other than those mentioned above like Sheet Metal Parts, Evaporator Coil, Condenser coil &
plastic components such as front grill “D” Block, Air Deflectors, louvers, etc, are excluded from the scope of this
contract.
2 Under the said AMC, Customer can avail Three (3) Services in a year for each unit by registering through Mobile
App, Web or Customer care centre. These services will be provided by Company’s engineer or through its
authorised service centre during the validity of this Contract.
3 If opted for with coil coverage both coils i.e. condenser and evaporator coils would be covered under AMC.

Terms & Conditions for Refrigerator:


The Company shall provide two types of Maintenance Contract Services viz (i) Labour Maintenance (ii)
Standard Maintenance Services as may be opted by the Customer.
Labour Maintenance Contract Service
Attendance of complaints call as and when called upon by the customer. Customer shall register the complaint
at JCH-IN Call centre only.
No components are covered under this contract and only service engineer visit charges are waived off. If during
the course of the contract company find that any parts need to be replaced, the same shall be indicated to
customer along with charges for repair/replacement/gas charging by our office/authorized service provider.
Standard Maintenance Contract Service
Attendance of complaints call as and when called upon by the customer. Customer shall register the complaint
at JCH-IN Call centre only.
Services mentioned in Labour Maintenance contract are covered under this contract. Other than that in case of
repairs or replacement, following components are covered under this contract:
Electrical Parts like Compressor, Timer/PCB, Relay, OLP, Capacitors, Fan Motors, Thermostat, Heaters,
Temperature Sensors, Wire Harness, Electrical Switches, Electrical Valves, Buzzer, Ice Maker, Sealed System
jobs- Gas Charging, Evaporator, Capillary, Drier.
The components other than those mentioned above and few of them like Cabinet and liner, plastic, rubber and
glass parts, doors, Door Gasket, shelves, painted / printed parts, Internal Leakage, bulb / LED are excluded
from the scope of this contract.
General Terms & Conditions applicable for Split and Window Air Conditioner, Refrigerator:
1. JCH-IN shall arrange its Authorised Representative to attend the unit, for any problems with the unit as and
when called upon. The complaint will be attended within 3 working days from the date it is notified to the
Company.
2. The Company shall arrange to undertake repair of the unit. If required the unit shall be taken to our service
station. Charges borne by service Provider inclusive of pick n drop of product.
3. Customers residing outside the municipal limits of the City / town of our service centre shall have to bring the
unit at his / her own expense to the service centre.
4. In case the service contract is to be entered into after the expiry of warranty period or of previous contract, the
contract will be accepted subject to checking of the equipment by the company's representative and verifying
that it is in working condition. In case unit is found defective and any repair needs to be done, then it will be
repaired first and taken into contract and the cost (labour and parts) shall be borne by the customer.
5. Any parts/services not covered /mentioned hereinabove in any type of the services shall be on chargeable
basis. The cost of such service/part shall be paid in advance by the customer.
6. Any defect in electrical installation outside the unit is not covered under this service and same shall be rectified
by the Customer including electrical supply points and accessories (viz plug points, MCB etc.) through its
Electrical Contractors. Any damage caused to the unit due to faulty electrical installation (wire fluctuation in
electric supply) shall be rectified by the Customer.
7. This contract covers only those unit/units installed at the address mentioned on care pack contract. In case of
shifting / reinstallation of the unit(s) the Customer shall intimate the same to the Company. Shifting activity
(dismantling and re-installation) of the said Units will be carried by the Company, however the cost of the same
(shifting) will be borne by the customer. The Company shall not be liable or responsible for any damage to the
units including the parts, if the Units are shifted by the Customer through third party. Damage to the unit and or
any parts in either case (i.e. by the company or by the customer through third party) shall not be covered under
this AMC
8. During the subsistence of this contract in case of change in location, the Company reserve the right to withdraw
from this contract for maintenance due to non-availability of its service centre in the particular location. In such
event the Company shall refund the balance amount of the contract to the Customer.
9. If either parties decides to terminate the maintenance contract before the half tenure completion of the contract,
a pro-rata fees shall be refunded after deduction of tax for the unexecuted period (full month). Post expiration of
half tenure no refund shall be applicable.
10. The company reserves the right to terminate the contract in case the unit is serviced/repaired/handled in any
manner by any other/third party without prior information to the Company, serial no of the unit is altered,
removed or defaced, neglect or cause other than normal use.
11. This contract doesn’t cover the defect caused by household pets, rats, cockroaches or any other animal or
insects. Service charges including part replacement due to above reason shall be borne by the customer.
12. The maintenance contract is not transferable and change of ownership brings the contract to an end.
13. FORCE MAJEURE CLAUSE: The Company shall not be liable for any break or non-performance or delay in
carrying out any of the obligations contained in this maintenance service including servicing / repairing of the
unit as a result of strike, lockout, industrial labour disturbance, fire, accidental damage, restriction imposed by
the government, circumstances beyond our control, any act of God, riot, any war or any condition arising from
similar causes beyond our control.
14. The parties shall strictly abide by the ethic policy and code of conduct as laid down by the Company.
15. The parties agree to maintain the confidentiality and shall not disclose any such matter to the third party expect
that is required under the law.
16. In case of any dispute or difference between the parties with regard to the terms and conditions of this contract
or any such services, the parties shall try to settle the same amicable within themselves. If the problem still
persist the parties shall be free to approach the proper courts having proper jurisdiction over the matter.
