MOTION TO REFER CASE TO THE CITY PROSECUTOR

COMES NOW, Petitioner, JERILYN VIGO PAZ, by counsel and unto

this Honorable Court, most respectfully avers THAT:

1. On March 26, 2018, Petitioner received an ORDER dated March 14,

2018 from this Honorable Court directing her to effect summons by
publication to the Respondent, and that the copy of the Petition be published
once a week for two (2) consecutive weeks in a newspaper of general
circulation within the Philippines, for failure to effect personal and/or
substituted service to the Respondent.

2. In its issues dated June 11 and June 18, 2018, People’s Bulletin, a
weekly newspaper of general circulation, duly registered with the Department
of Trade and Industry, published the petition for the above-titled case.

3. The period of sixty (60), counted from the last day of Publication, to
which Respondent shall file his responsive already lapsed, without the latter
filing the same.

4. In view of the foregoing, Petitioner prays that the instant case be

referred to the Provincial Prosecutor of San Pedro, Laguna, for determination,
if there is collusion between parties, in compliance with the rules.

Honorable Court that this manifestation be noted
