LEASE AGREEMENT

THIS LEASE AGREEMENT is made and executed at NOIDA, on 28 December 2018,


between

MR. Sachin Kumar S/o Inder Singh R/o 27A New Krishna Nagar, Mathura U.P -281004
(Hereinafter called the First party/landlord/owner) which expression shall mean and include his
legal heirs, successors, legal executors, representatives, administrators, nominees and assign.

AND

Mr. Saba Alam S/o Late. Sarwar Alam R/o 15/109-110 Trilokpuri New Delhi -110091
which expression shall mean and include his/her/their legal heirs, successors, legal
representatives, executors, administrators, nominees and assign.
Whereas the first party is/are the absolute owner and in physical possession of the FLAT NO
B1/1010, Tower-12A, Purvanchal Royal Park, Sector-137, NOIDA, UTTAR-PRADESH
(Hereinafter called the said premises)
AND WHEREAS the second party has approached the first party to let out the said premised on
rent and the first party has agreed to let out the same on rent on the following agreed terms
and conditions:-

NOW THIS DEED OF LEASE WITHNESSETH AS UNDER:-

1. That the tenancy of the premises will commence with effect from 18th January 2019
and be valid for a limited period of 11 month (till 17th December 2019) and on the
expiry of tenancy period, the tenant shall vacate and hand over vacant possession of the
said premises in a good & clean condition to the owner only without any hitch and
hindrances. In case this agreement is renewed (on a mutual discussion) for another
period of 11 months, the rent will be increased. The amount of increase in rent would be
10% of the previous period rent.

2. That the rent for the property and fittings provided therein payable by the tenant of the
owner shall be Rs. 17000/-(Rupees Seventeen Thousand only). The rent is inclusive of
society maintenance charges which will be paid directly by owner to the society.

3. That the tenant shall pay Rs. 34,000/-( Rupees Thirty Four Thousand only) through Bank
transfer as security deposit to the owner, free of interest, which shall be refunded to the
tenant on the expiry of the lease after deducting any arrears on rent, electricity, water
dues, any damage or loss charges or any other charges liable on the tenant owing to
their occupancy of the premises on rent.

4. That the tenant shall pay one month rent in advance to the owner which shall be adjusted in
the first month of the lease period. The tenant shall pay the rent of the lease period
duration (11 months starting from 29th December 2018) through bank transfer by
1st day of every month.

5. That the Tenant shall use the 1said premises only for residential purposes of self and
dependent family and not for any other purposes.

6. That the tenant/second party shall not sublet the said premises or any portion thereof
to any persons or persons under any circumstances.

7. Other than the rent, the tenant/second party will pay the mains & back-up electricity
charges, gas charges and water charges along with any fixed charges for electricity, gas
or water as per consumption of meter reading to concerned authority directly. The
tenant would also give the original receipts of bill to the owner /first party for record
purpose of the owner.

8. That the Tenant /second party is having two sets of original keys of the Flat main door &
One set for all the rooms / balcony doors, In case any of the door key is lost the Tenant
/second party will bear the cost of replacing it with new lock or else it will be deducted
from the security deposit paid by the Tenant / Second Party.

9. That the tenant /second party shall not make any structural additions or alteration in the
said premises without the written consent of the owner /First party. However, first party
permits for the installation of Air-Conditioners, Exhaust Fan, as may be necessary for
convenience of the second party. Nails or drill holes in the wall shall be made as minimum
as possible (Permitted only for the items which are important).
10. That the owner /first party will be at liberty to inspect the said premises at any
reasonable time in the presence of the Tenant /second party.

11. That the Tenant/ second party will maintain the said premises and he/she/they shall
always keep the same premises neat and clean and tenantable worthy and not damage
the said premises or change any portion thereof in any circumstances. The fitting and
fixtures provided in the premises are as in the Annexure A (Fittings, Fixtures & Keys).
Cost of damages or loss, if any, to fittings, fixtures & keys mentioned in Annexure A
(Fittings, Fixtures & Keys) of this deed shall be recovered by the owner / first party from
the interest free security deposit.

12. That the Agreement may be earlier terminated by either side giving one month’s
advance notice in writing to the other party. Otherwise the amount equivalent to one
month rent i.e. Rs 17000/- will be deducted from the security deposit amount.

13. That the Tenant /second party will not violate any terms and conditions of the
concerned authorities of NOIDA authorized Electricity Board, society and all other
concerned Government or local agency relating on the above said premises.

14. The rental premises is a part of society which is a community living. The tenant will, at all
times, adhere to various rules and regulations of the society, will not create any
nuisance or trouble which may impact the neighbors and other occupants of the
building & the society.

15. That day to day minor repair, if any, of the said premises shall be carried out by the
tenant /second party at his own costs. However, any defects like seepage, cracks or non-
functional of any fittings and fixtures etc. would be repaired by the first party.

16. Both the parties shall abide by the rules and regulations of rent control ACT and terms
and condition of this Lease Deed.

17. That the present Deed of Lease has been executed under the free will and consent of
both the parties and neither party has signed under any pressure, threat, coercion etc.

18. That the owner will give one covered parking - Parking No. LC-79 (covered) provided by
the society with the flat.
19. Gas supply meter reading as on 18th Januray 2019 is ------------------------------------

21. Jurisdiction shall be that of Noida Court Only.

IN WITNESSES WHEREOF, the owner/first party and tenant/ second party have signed this
Lease Deed on the day, month and year first written above.
