COUNTER AFFIDAVIT
That I, JO1 RODNEY T SUPERALES JMP, of legal age, Filipino, and a resident of Blancia Street,
Molave, Zamboanga del Sur, Philippines, and presently assigned at Dumingag Municipal Jail, Dumingag,
Zamboanga del Sur, after having been duly sworn to, in accordance with law, do, hereby state the
following to wit:

1. That in so far as Administrative Case No. 15-01 for Grave Misconduct filed against me at the
Regional Office of BJMPRO-IX, Lenienza, Pagadian City is concerned, I’m strongly negating
such allegation because there was no rescinding of request I made to the National
Headquarters regarding my swapping of assignment to a certain JO1 Lasprilla of BJMPRO-
4A.

2. That the action I requested from the National Headquarters sometime on May 2014 is just a
“Hold in Abeyance” while I’m still attending for the possible settlement of my problem on
my house and lot sold to JO2 Niño P Rodriguez which is filed before MTC Branch – 1 of
Pagadian City. (Hereto Attached)

3. That because of the misconception of the National Headquarters that I requested for the
cancellation of my swapping they issued a memorandum dated 26 May 2014 to annul our
request.

4. That on 04 July 2014 a Mediation Agreement was done at the Office of the Hearing Officer
of BJMPRO-9 between me and my complainant that if ever no transfer order coming from
the National Headquarters will come relative to my request of swapping of assignments, I
will return the full amount of money involved in our transaction to Mrs. Armalyn J. Lasprilla,
my complainant in order to put an end to her complaint against me. (Pls. see attached copy
of the Mediation Agreement)

5. That after the mediation agreement, I tried my best to request again to the National
Headquarters regarding our swapping of assignments but up to this time, no reply has been
made.

6. That to solve this case, on 23 January 2015, I and Mrs. Armalyn J. Lasprilla, my complainant
entered into an amicable settlement. Thus, prompting the later to file an affidavit of
desistance to the above – mentioned case. (Hereto Attached)

7. That I am executing this affidavit in order to attest to the truth and veracity of all foregoing
statements and for whatever legal purpose this may serve.
