DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY

WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, RICARDO MIRANDA ROSAL, died intestate at Gavino Alvarez


Hospital, San Pedro, Laguna on 9 August 1996, leaving no will nor debts settled to
date but leaving a parcel of land;

WHEREAS, at the time of his death, he left as forced heirs, the following and
to wit:

LUCIA ANCIANO ROSAL (Deceased), spouse of Ricardo Miranda


Rosal, of legal age, Filipino, widow with residence at San Vicente, San Pedro,
Laguna;

ROBERTO ANCIANO ROSAL (Deceased), spouse of Ricardo Miranda


Rosal, of legal age, Filipino, widow with residence at San Vicente, San Pedro,
Laguna;

ELISA SERADILLA ROSAL, of legal age, Filipino, single, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro
Laguna;

ALQUINO ELVIRA ROSAL, of legal age, Filipino, married, and with


residence and postal address at 119 Northview Country Homes Soro-Soro,
Biñan, Laguna;

CARINA ROSAL RIVERO, of legal age, Filipino, married, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro
Laguna;

ROSALITO ANCIANO ROSAL, of legal age, Filipino, married, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro
Laguna;

RODRIGO ANCIANO ROSAL, of legal age, Filipino, married, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro

ROLANDO ANCIANO ROSAL, of legal age, Filipino, married, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro

ELENA ROSAL LICOP, of legal age, Filipino, married, and with


residence and postal address at San Vicente St. Brgy. San Vicente, San Pedro
Laguna;

WITNESSETH:

THAT we are the legitimate children and spouse, respectively, of RICARDO


MIRANDA ROSAL, who died on 9 August 1996 in San Pedro, Laguna; copy of his
death certificate is hereto attached as Annex “A”;

THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;

THAT said deceased, at the time of his death, left a certain real property,
situated in San Pedro, Laguna and more particularly described as follows, to wit:

WHEREAS, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate over the
same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court of
the Philippines, subject to the liabilities imposed by Section 4, of the same rule.

WAIVER OF RIGHTS

WHEREAS, We, ELISA SERADILLA ROSAL, ALQUINO ELVIRA ROSAL,


CARINA ROSAL RIVERO, ROSALITO ANCIANO ROSAL, RODRIGO ANCIANO
ROSAL, ROLANDO ANCIANO ROSAL, and ELENA ROSAL LICOP (whose personal
circumstances is mentioned above) has agreed and covenanted to CEDE, TRANSFER
and CONVEY unto our co-heir ELISA SERADILLA ROSAL (whose personal
circumstances are mentioned above), their heirs and assigns the full ownership and
possession of the above-described property.

NOW, THEREFORE, for and in consideration of the foregoing premises, We


waived and renounced as by these presents, We hereby WAIVE and RENOUNCE our
share, right and participation over the above-described property in favor of ELISA
SERADILLA ROSAL their heirs and assigns the full ownership and possession of the
above-described property.
