Petitioner Lower Elwha Housing Authority (LEHA) filed a
Petition for Unlawful Detainer against Respondent Oliver
Charles, Jr., on September 20, 2018 (No. 2018-CV-LEHA-0001).
Due to issues with timelines under the LEKT Eviction Procedures
Ordinance, LEHA subsequently moved to dismiss that case without
prejudice and filed a new Petition for Unlawful Detainer against
Respondent on February 20, 2019 (No. 2019-CV-LEHA-0001) .
The Court conducted a hearing on April 15, 2019. LEHA was
represented by Attorney Justin Kover. Also present were LEHA
Director Gerald Charles and Housing Tax Credit Supervisor
Jennifer Hutto. Mr. Charles appeared and was represented by
Attorney John Black.
Mr. Black stated that Respondent did not oppose LEHA’s
motion to dismiss the earlier case without prejudice, and the
Court granted the motion. The parties agreed that the matter
should be considered again by the LEHA Board as a result of new
information Respondent wishes to present, and the Court approved
the plan. Accordingly, the Court proceedings in No. 2019-Cv-
LEHA-0001 shall be held in abeyance, and the matter is
temporarily remanded to the LEHA Board. The Court was informed
that the LEHA Board is willing to meet with Respondent at their
regularly scheduled session on April 18, 2019.
The Court will conduct a further hearing on April 22, 2019,
at 1:00 p.m. At that time, the parties will report to the Court
regarding the status of proceedings before the LEHA Board. The
parties shall be prepared to go forward with Court proceedings,
as appropriate.
