II. OFFER OF THE TESTEMONY

The testimony of the prosecution witness is being offered to prove:

1. The presence of Mr. Hero L. Santos at the victim’s house before she
was stab.

2. That, Hero L. Santos killed his mother, Gemma L. Santos by stabbing

her.

III. JUDICIAL AFFIDAVIT PROPER

1. Q - Please state your name, age, residence, and

occupation of the witness.
A - I, Philip A. Santos, 60 years old, widower, Filipino, and
residing at No. 42 Dalandan St., Pasay City. I am a teacher.

2. Q - Why are you here now?

A - To give a sworn statement by way of a judicial affidavit,
the same to constitute as my direct testimony relative to the killing
of my wife.

3. Q - May you please state the name of your wife and her other
personal circumstances.
A - The name of my wife is Gemma L. Santos, 59 years old,
Filipino and former a chef.

4. Q - How long have you been married?

A - 30 years this February 14, 2018

5. Q - How can you prove your marriage with her?

A - I have here a copy of our Certificate of Marriage. (Exhibit
“A”)

6. Q - Within 30 years of being married, how many children do

you have?
A - Only one.

7. Q - May you please tell me the name of your child and other
personal circumstances
A - Our only son is Hero L. Santos, 26 years old, single,
Filipino, and residing at No. 42 Dalandan St., Pasay City

8. Q - How can you prove that he is your son?

A - I have here a copy of his birth certificate. (Exhibit “B”)

9. Q - You mention that you are here to testify about the killing
of your wife. When did your wife died?
A - At the night of January 15, 2018
10. Q - Where were you at the night of January 15, 2018?
A- I am at our house located at No. 42 Dalandan St., Pasay
City

11. Q - Who were with you that night?

A- I am with my wife and my son.

12. Q - What were you doing that night?

A- At around 7:00pm, we were eating dinner when
eventually my son asked his mother for some money and
permission to go out with his friends.

13. Q - What did your wife say?

A- She did not allow him to go out and did not give her
money because we don’t have money that time and it is already
late.

14. Q - What was the reaction of Hero after he heard his mother?
A- He looked so furious and walked out on our dining table.

15. Q - Where did he go?

A- He stormed off to his room.

16. Q - What did he do inside his room?

A- I really don’t know because I did not follow him in his
room. Maybe he got something in his room because a few
minutes later he returned, this time with a “Balisong” in his hand.

17. Q - What did he do with the “Balisong”?

A- He rushed toward her mother, stabbing her multiple times
at her back.

18. Q - What did you do upon seeing that your son is stabbing
your wife?
A- I tried to prevent him from killing his mother but he was
way stronger than me that he pushed me away and the moment I
reached my wife she was covered in blood, I shouted for help
then my son ran out of our house.

19. Q - What did you do after he stabbed your wife?

A- I hugged my wife and shouted for help but. Then, I
decided to call the police hotline.

20. Q - What did they say?

A- They said, that they will immediately send for some
medical assistance and some policemen to investigate the scene.

21. Q - When did the medical assistance and the policemen

arrive?
A- I called them around 7:30 in the evening, a few minutes
later an ambulance first arrived to bring us to the hospital
 22. Q - Where did the ambulance brought you?
A- At Adventist Medical Center

23. Q - What happened when you arrived at hospital?

A- We were brought immediately to the emergency room,
where doctor and nurses tried to revive my wife but she was
declared dead on arrival.

24. Q - How can you prove that you wife is dead?

A- I have a copy of my wife’s death certificate. (Exhibit “C”)

25. Q - Do you have anything to add?

A- None.
