EXTRA JUDICIAL SETTLEMENT OF

ESTATE WITH SPECIAL POWER OF ATTORNEY


KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT, made and entered into at the City of


Tanauan, Province of Batangas, Philippines this
_______________________, by and between:

The HEIRS of RODRIGO AVEDO, namely:

1. HERMINIA PAMPLONA ABIDO, widow, of legal


age, Filipino, and a resident of 16611 Amberwood Way, Cerritos,
California;

2. CYNTHIA ABIDO MAES, married to Jeffrey Alan


Maes, of legal age, Filipino, and a resident of 10 Old Wood Road,
Pomona, Calfiornia; and

3. LEILA ABIDO JUDD, married to Jamieson Patrick


Judd, of legal age, Filipino, and a resident of 16611 Amberwood
Way, Cerritos, California;

WITNESSETH: That -

WHEREAS, on August 02, 2014 , RODRIGO AVEDO died


intestate at Long Beach, California, leaving a certain real property
(1/2 thereof only) and more particularly described as follows:

“A parcel of land (Lot 4864-A, of the subdivision plan, Psd-


04-092457, being a portion of Lot 4864, Cad-168, Tanauan
Cadastre, L.R.C. Record No. ), situated in the Barangay of Cale,
Municipality of Tanauan, Province of Batangas, Bounded on the
NE., along line 1-2 by Lot 4864-B, of the subdivision plan; on the
SE., along line 2-3 by Lot 4865; on the SW., along line 3-4 by Lot
4867; on the NW., along line 4-1 by Lot 4863, all of Cad-168,
Tanauan Cadastre. Beginning x x x containing an area of SIX
THOUSAND TWO HUNDRED FIFTEEN (6,215) SQUARE
METERS. x x x.”

WHEREAS, the parties hereto are all the legal heirs of


decedent RODRIGO AVEDO, namely: HERMINIA
PAMPLONA ABIDO, CYNTHIA ABIDO MAES, married to
Jeffrey Alan Maes, and LEILA ABIDO JUDD, married to
Jamieson Patrick Judd, and therefore, considered as the owners of
the above mentioned property (1/2 thereof only):

WHEREAS, there are no known debts or obligations due


against the estate of the above mentioned decedent.

WHEREAS, it is to the best interest of the parties hereto to


divide and partition and adjudicate among themselves, the entire
estate (1/2 thereof only) extra judicially in the form and manner
hereinafter set forth.

NOW THEREFORE, for and in consideration of the


premises and invoking the provisions of Rule 74, Section 1, of the
Rules of Court, the parties hereto do by these presents agree to
divide, and partition the entire estate (1/2 thereof only) of the
decedent above mentioned and accordingly adjudicate, as they
do hereby adjudicate the same among themselves in pro-indiviso
equal shares, subject however, to the liabilities imposed by Rule 74,
Section 4, of the Rules of Court, in favor of any other possible heirs,
creditors and other persons who might be deprived of their
lawful participation in the estate of the decedent Rodrigo Avedo,
for a period of two (2) years.

That in the event that any other property of the decedent


above mentioned is found which is not included hereinabove, the
parties hereto further agree to distribute, divide and adjudicate the
same in like manner and proportion as herein established and
disposed.

SPECIAL POWER OF ATTORNEY


KNOW ALL MEN BY THESE PRESENTS:

We, HERMINIA PAMPLONA ABIDO, of legal age,


widow, Filipino citizen and a resident of 16611 Amberwood Way,
Cerritos, California, CYNTHIA ABIDO MAES, married to Jeffrey
Alan Maes, of legal age, single, Filipino citizen and a resident of 10
Old Wood Road, Pomona, Calfiornia, and LEILA ABIDO JUDD,
married to Jamieson Patrick Judd, of legal age, single, Filipino
citizen and a resident of 16611 Amberwood Way, Cerritos,
California, do hereby name, constitute and appoint MANUEL E.
PAMPLONA, of legal age, Filipino citizen, and a resident of
Barangay Cale, Tanauan City, Batangas, Philippines, to be our true
and lawful attorney-in-fact, for us and in our name, place and stead,
to do and perform the following acts and things, namely:

1. We are the owners of the above mentioned parcel of land


situated in the Barangay of Cale, Municipality of Tanauan, Province
of Batangas, with an area of SIX THOUSAND TWO HUNDRED
FIFTEEN (6,215) SQUARE METERS, which property is covered
by Transfer Certificate of Title No. T-65636. Hence, this Special
Power of Attorney to sell, negotiate, coordinate, transact to
prospective buyer or buyers, alienate and dispose the said parcel of
land, and more particularly described as follows:

Bounded on the NE., along line 1-2 by Lot 4864-B,


of the subdivision plan; on the SE., along line 2-3 by
Lot 4865; on the SW., along line 3-4 by Lot 4867; on
the NW., along line 4-1 by Lot 4863, all of Cad-168,
Tanauan Cadastre. Beginning x x x containing an
area of SIX THOUSAND TWO HUNDRED
FIFTEEN (6,215) SQUARE METERS. x x x.”

2. To sign, execute and deliver any documents, contracts and


agreements, Deed of Conditional Sale, Contract to Sell, Deed of Absolute
Sale and Acknowledgement Receipt, and any other documents in our
name and in our behalf with regard to the sale, alienation and disposition
of the above described property.

3. To SELL, TRANSFER AND CONVEY the above mentioned


property in our name and in our behalf.

4. To ask, demand, collect, receive, encash, deposit, and withdraw all


sums of money and/or checks payable to and in the name of our said
attorney-in-fact that may be derived from the consideration of the sale,
alienation and disposition of the above described property in our name and
in our behalf.

5. To represent us before the Bureau of Internal Revenue (BIR),


Department of Agrarian Reform (DAR), Register of Deeds, Assessor’s
Office and all other government agencies with respect to the above
described property and sign documents needed for the said agencies.

6. To pay the Capital Gain Tax, Documentary Stamp Tax, Estate


Tax with the Bureau of Internal Revenue (BIR), filing fees, registration
expenses, Transfer Tax, and other taxes with other government agencies
in our name and in our behalf with respect to the real property described
above.

7. To delegate the powers and authorities conferred herein to


another person and appoint a substitute for the attorney in fact herein.

8. To do and perform such acts as may be incidental or necessary


to carry out the power herein conferred.

This Special Power of Attorney shall not be revoked nor cancelled by


the Principals or any of their heirs or assigns.

HEREBY GIVING AND GRANTING unto our said attorney-in-fact


full power and authority to do and perform any and every act and thing
whatsoever requisite or necessary or proper to be done in and about the
premises, as fully to all intents and purposes as we might or could do if
personally present and acting in person.

HEREBY RATIFYING AND CONFIRMING all that our said


attorney-in-fact or his substitutes shall lawfully do or cause to be done
under and by virtue of these presents.
