1 AN ACT

2 relating to the delivery of alcoholic beverages by the holder of a

3 wine and beer retailer ’s permit.

4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

5 SECTIONA1.AAChapter 25, Alcoholic Beverage Code, is amended

6 by adding Section 25.15 to read as follows:

7 Sec.A25.15.AADELIVERIES AND COLLECTIONS. The holder of a

8 wine and beer retailer ’s permit who is also the holder of a local

9 cartage permit may make deliveries to and collections from ultimate

10 consumers in the same manner as the holder of a package store permit

11 under Section 22.03.

12 SECTIONA2.AASection 43.01, Alcoholic Beverage Code, is

13 amended by adding Subsection (c) to read as follows:

14 (c)AAA package store, wine only package store, or wine and

15 beer retailer ’s permittee who also holds a local cartage permit may

16 make deliveries to and collections from customers in accordance

17 with Section 22.03, 24.03, or 25.15, as appropriate.

18 SECTIONA3.AASection 43.04, Alcoholic Beverage Code, is

19 amended to read as follows:

20 Sec.A43.04.AAELIGIBILITY FOR PERMIT. The commission may

21 issue a local cartage permit to a warehouse or transfer company or

22 to a holder of a package store, wine only package store, wine and

23 beer retailer ’s, or local distributor ’s permit.

24 SECTIONA4.AASection 74.01, Alcoholic Beverage Code, is

1 amended by adding Subsection (h) to read as follows:

2 (h)AAThis section does not authorize the holder of a brewpub

3 license who also holds a wine and beer retailer ’s permit to deliver

4 alcoholic beverages directly to ultimate consumers for off-premise

5 consumption at a location other than the licensed premises.

6 SECTIONA5.AAThis Act takes effect September 1, 2019.
