This Deed is entered into and executed by and among the HEIRS OF EUSTAQUIO
JUGUILON, namely: GLORIA JUGUILON-PABAYOS, married; for herself and in behalf of
her brother FELICIANO E. JUGUILON by virtue of a Special Power of Attorney known as Doc.
No. 82; Page No. 17; Book XLIX; Series of 2013, and sister MARTHA J. MINDO by virtue of a
Special Power of Attorney known as Doc. No. 83; Page No. 17; Book No. XLIX; Series of 2013;
all notarized by Atty. Elizur Umbac, Notary Public; ENEMESIA E. JUGUILON, single;
HONORATO E. JUGILON, single; GEMMA E. JUGUILON, single, in her behalf and in behalf
of her sister HERMINIA J. MORENO, by virtue of a Special Power of Attorney known as Doc.
No. 258; Page No. 52; Book No. 37; Series of 2014, notarized by Ryan D. Tabanay, Notary
Public; FEDERICO E. JUGUILON, married ; CHRISTOPHER JUGUILON, married and
ALBINO JUGUILON, married; all of legal age, Filipinos and residents of barangay Ajong,
Sibulan, Negros Oriental;
WITNESSETH:
That EUSTAQUIO JUGUILON, during his lifetime, was an absolute owner of a certain
parcel of land known as Lot No. 9869, under Tax Declaration No. 41-0008-09631, located in
Sitio Cansulang, barangay Looc, Santander, Cebu, with an area of ONE THOUSAND FIVE
HUNDRED TWENTY THREE (1,523) Square Meters, more or less; which parcel of land is
more particularly described as follows, to wit: Bounded on the North by boundary Bunlan; on
the east by Lot No. 9870; on the South by Lot No. 9871; and on the West by Lot No. 9872 &
Boundary Bunlan;
That EUSTAQUIO JUGUILON, died intestate long time ago in Ajong, Sibulan, Negros
Oriental, leaving without any testamentary will nor debts not settled until the present and upon
his death he was survived by the parties herein, his legitimate children, grandchildren and only
compulsory heirs;
That invoking the provisions of Section 1, Rule 74 of the New Rules of Court of the
Philippines and in accordance with the laws on intestate succession, the herein Heirs of
EUSTAQUIO JUGUILON, by these presents, DO HEREBY settle and adjudicate unto
themselves the above-described parcel of land, in accordance with their rights, interests and
participations over the said parcel of land;
That further, the parties herein declare that the said parcel of land is not tenanted nor
worked upon by an agricultural lessee for the herein parties are the ones in possession of the said
parcel of land and that this transaction is in consonance with the provisions of the
Comprehensive Agrarian Reform Law of the Philippines because this lots belong to their
respective retention limits.
