DEED OF HEIRSHIP AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by JETHER M. BANQUERIGO, for herself and
in behalf of her sister RUTH LAARNI B. ALESNA, by virtue of a Special Power of Attorney
known as Doc. No. 321; Page3 66; Book III; Series of 2013 and in behalf of her brother
JETHRO M. BANQUERIGO, by virtue of a Special Power of Attorney, known as Doc. No. 322;
Page 66; Book III; Series of 2013, both documnent were notarized by Atty Mark Christoffel L.
Banquerigo, Notary Public; of legal age, Filipino, single and a resident of Tubod, Iligan City,
hereinafter called the Vendor, in favor of,

TIRSO F. BANQUERIGO, likewise of legal age, Filipino, married to Maria Rowena De


Leon and a resident of barangay Poblacion, Sibulan, Negros Oriental, hereinafter referred to as
the Vendee;

WITNESSETH:

That originally, the Cadastral Court of Negros Oriental has awarded Lot No. 642 to
spouses Pedro Regalado and Alfonsa Basubas, one half (1/2) portion and the other One half (1/2)
to spouses Cornelio Calugcugan and Catalina Calingacion;

That Spouses Cornelio Calugcugan and Catalina Calingacion died intestate sometime
ago, leaving without any known debts not paid until the present and upon their death they were
survive by their grandchildren, namely: RUTH LAARNI, JETHER and JETHRO, all surnamed
BANQUERIGO;

That the heirs of Spouses Pedro Regalado and Alfonsa Basubas and Heirs of Spouses
Cornelio Calugcugan and Catalina Calingacion had orally partitioned Lot No. 642 into two
sublots, to wit: Lot No. 642-A, consisting of Three Hundred Eighty Two (382) Square Meters,
more or less, and Lot No. 642-B consisting of Three Hundred Eighty three (383) Square Meters,
more or less; and they have agreed that Lot No. 642-A shall belong to the Heirs of spouses
Cornelio Calugcugan and Catalina Calingacion while Lot No. 642-B, shall belong to the Heirs
of Pedro Regalado and Alfonsa Basubas;

That invoking the provisions Section 1, Rule 74 of the New Rules of Court and in
accordance with the law on intestate succession, the vendor herein have settled and adjudicated
unto themselves, Lot No. 642-A, consisting of Three Hundred Eighty two (382) square meters,
more or less;

That for and in consideration of the sum of THREE HUNDRED FIFTY THOUSAND
PESOS (Php 350,000.00), Philippine Currency, in hand paid by the herein Vendee, and receipt in
full is hereby acknowledged by Vendor to her entire satisfactions and that by virtue of these
presents, the herein Vendor does hereby SELL, TRANSFER, and CONVEY unto the vendee, her
heirs and assigns, all the vendor’s rights, interest, and participation over the aforementioned
parcel of land, Lot No 642-A, including all the improvements found therein, free from all liens
and encumbrances;

That the vendor herein declares that due notice has been given to all persons affected by
this transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the
said rights and the said land is not covered by the Comprehensive Agrarian Reform Law of the
Philippines for being a residential Land and the vendor warrants her title and ownership over the
said parcel of land and will defend the rights of the vendee against any adverse claim
whatsoever.

BEFORE ME, this ____day of May, at Dumaguete City, Negros Oriental, personally
appeared the Vendor, Jether M./ Banquerigo and vendee, Tirso F. Banquerigo, who exhibited to
me their Community Tax Certificates Nos, ________and 21338054, issued on ____________,
2014, and January 27, 2014, at Sibulan, Negros Oriental, both known to me to be the same
persons who executed the foregoing Deed of Sale consisting of two (2) pages including this
page of acknowledgment and all pages were duly signed by the parties together with their two
instrumental witnesses and that they acknowledged to me that the same is their free act and
voluntary deed.
