What are the various punishments to which offenders are liable under the provisions of the

Penal Code? Explain death sentence. Discuss it about 250 words. (Ch 3 Criminal )

Under the Penal Code, every person shall be liable to punishment and not otherwise
for every act or omission contrary to the provions thereof, which he shall be guilty within the
Republic of the Union of Myanmar. The principal object of punishment is the prevention of
offences and the measure of punishment must, consequently, vary from time to time
according to the prevalence of a particular form of crime and other circumstance. An amount
of severity may be very appropriate at one time, which would be quite uncalled for at another.

There are four kinds of punishments to which offenders are liable under the provision
of the Penal Code. They are

(1) death

(2) imprisonment which may be either (a)rigorous, that is, with hard labour

(3) forfeiture of property and

(4) fine.

According to the Law Amending to the Penal Code 2016, transportation is equal to
the imprisonment for a term of twenty years.

Death

Death is the highest form of punishment. It may be awarded as punishment in following


cases.

(1) Being under sentence of imprisonment for a term of twenty years.

(2) With premeditation.

(3) In the course of committing any offence punishable under this Code with imprisonment
for a term which may extend to seven years, shall be punished with death, and shall also be
liable to fine.

It may be awarded as punishment for the following offences.

(1) Punishment of high treason

(2) Abetment of mutiny

(3) Abetment of suicide of child or insane person

(4) Dacoity with murder

(5) Attempt to murder & Attempts by life convicts


In every case in which sentence of death shall have been based the President of the
Union may, without the consent of the offender, commute the punishment for any other
punishment provide by this Code.
