1 which infringes the Patents-in-Suit, are directed to a division of the website operated
2 by Getac, Inc. A true and correct screen shot from Getac’s website for GETAC K120
3 and a page for requesting a quote for the product, as of the time of drafting this
4 complaint, are attached as Exhibits E and F, respectively.
5 JURISDICTION AND VENUE
6 7. This Court has jurisdiction over the subject matter of this action under 28
7 U.S.C. §§ 1331, 1332, and 1338(a).
8 8. On information and belief, GTC and Getac, Inc. are part of a world-wide
9 effort to compete in the rugged computer industry. As shown in the Getac Corporate
10 Video on the www.getac.com website, Getac designs and delivers Getac’s “rugged
11 solutions . . . in more than 40 countries, offering local support through [its] worldwide
12 service network.” A true and correct screen shot from Getac, Inc.’s website of the
13 Getac Corporate Video, as of the time of drafting this complaint, is attached as Exhibit
14 G.
15 9. On information and belief, this Court has personal jurisdiction over GTC
16 by virtue of, inter alia, GTC’s continuous and systematic activities in California with
17 and through Getac, Inc., GTC’s wholly owned subsidiary, advertising of the GTC
18 products in California and elsewhere through the www.getac.com website, by
19 encouraging interested consumers to contact Getac sales representatives in California,
20 and, upon information and belief, through substantial sales of GTC’s products directly
21 to consumers and/or through authorized Getac suppliers located in California.
22 10. This Court has personal jurisdiction over Getac, Inc. by virtue of, inter
23 alia, Getac, Inc.’s incorporation in Irvine, California, having, upon information and
24 belief, conducted business in California such that it should reasonably anticipate being
25 haled into court in this judicial district, and having engaged in systematic and
26 continuous contacts with the State of California, including through the purposeful
27 marketing and offering for sale of the infringing products in this judicial district, and

1 upon information and belief, through the receipt of revenue from the sales and
2 marketing of infringing products in, and to residents of, this judicial district.
3 11. On information and belief, GTC also participates in, influences and
4 controls Getac, Inc. management decisions. For example, GTC’s Vice Chairman,
5 Francis Tsai, is the sole Board Member of Getac, Inc. and GTC’s Vice President,
6 Rowina Lee, is a Key Executive for Getac, Inc. True and correct screen shots of Getac
7 group’s website listing the GTC directors and Bloomberg’s report on Getac, Inc., as of
8 the time of drafting this complaint, are attached as Exhibits H and I, respectively.
9 12. Venue is proper in the Central District of California under the general
10 federal venue statute, 28 U.S.C. §§ 1391(b), (c), and (d) because Getac, Inc. is deemed
11 to reside in this District and GTC has performed continuous and systematic activities
12 in California itself and through Getac, Inc. In addition, and in the alternative, venue is
13 proper in this judicial district under the specific venue provision relating to patent
14 infringement cases, 28 U.S.C. § 1400(b) because Defendants have committed acts of
15 infringement in this District.
16 PATENTS-IN-SUIT
17 13. On September 13, 2016, the USPTO duly and legally issued the ’D232
18 Patent entitled “Portable Computer.”
19 14. The ’D232 Patent is valid and enforceable.
20 15. Panasonic is the sole assignee and owner of all right, title and interest in
21 and to the ’D232 Patent.
22 16. On May 24, 2016, the USPTO duly and legally issued the ’D994 Patent
23 entitled “Potable [sic] Computer.”
24 17. The ’D994 Patent is valid and enforceable.
25 18. Panasonic is the sole assignee and owner of all right, title and interest in
26 and to the ’D994 Patent.
27 19. On May 24, 2016, the USPTO duly and legally issued the ’D998 Patent
28 entitled “Portable Computer.”

1 31. The CF-33 debuted on February 27, 2017 at the MWC Barcelona 2017.
2 32. The MWC Barcelona is the largest mobile technology event in the world
3 with attendees coming from thousands of leading-edge technology companies and is
4 widely known to assemble today’s visionaries to explore the hottest topics influencing
5 the industry.
6 33. On information and belief, Getac also participated in the MWC Barcelona
7 2016 to introduce its product, Getac RX10. A true and correct copy of Windows Blog
8 post of the MWC Barcelona 2016 addressing the CF-20 and the Getac RX10 is attached
9 as Exhibit M.
10 34. On information and belief, as a company involved in the same industry of
11 rugged portable devices, Getac would have been aware of the CF-20 through at least
12 the MWC Barcelona 2016.
13 35. On information and belief, Getac would have also been aware of the CF-
14 33 through at least the product’s debut at the MWC Barcelona 2017.
15 36. In addition to the publicity of the Toughbooks, at least as early as October
16 3, 2017, pursuant to 35 U.S.C. § 287(a), Panasonic provided on its website the list of
17 patents it owns along with the product names, which included the Toughbooks and the
18 Patents-in-Suit. A true and correct screen shot of Panasonic’s website listing the
19 product names of all its TOUGHBOOK® series and their relevant patents is attached
20 as Exhibit N.
21 37. As a result, Getac had actual and/or constructive notice of the Patents-in-
22 Suit.
23 COUNT I: INFRINGEMENT OF THE ’D232 PATENT
24 38. Panasonic alleges and incorporates by reference the allegations set forth
25 in paragraphs 1 through 37.
26 39. As shown by the side-by-side comparison below, Getac has
27 misappropriated Panasonic’s patented portable computer design in the accused
28 GETAC K120.

14 40. On information and belief, GETAC K120 was first launched in September
15 19, 2018—more than 2 years after the CF-20 was introduced at the MWC Barcelona
16 2016.
17 41. GETAC K120 is deceptively similar and substantially the same as the
18 patented design of the ’D232 Patent when viewed through the eyes of the ordinary
19 observer and considering the infringing product as a whole. A true and correct copy of
20 a post on ruggedpcreview.com viewing GETAC K120 as Getac’s equivalent of the CF-
21 33 is attached as Exhibit O.
22 42. On information and belief, Getac used its knowledge of the Toughbooks
23 and copied the designs covered by the Patents-in-Suit.
24 43. Getac’s unauthorized use, offer for sale, sale and importation into the
25 United States of GETAC K120 during the term of the ’D232 Patent infringes the ’D232
26 Patent.
27 44. Getac’s unauthorized use, offer for sale, sale and importation into the
28 United States of GETAC K120 is without authorization from Panasonic.

1 45. Getac’s unauthorized use, offer for sale, sale and importation into the
2 United States of GETAC K120, which incorporates the patented design of the ’D232
3 Patent, has caused, and will continue to cause, Panasonic financial and reputational
4 harm.
5 46. Despite having constructive notice of its infringement of the ’D232 Patent,
6 Getac has infringed, and will continue to infringe unless enjoined, the ’D232 Patent.
7 47. Getac’s infringement of the ’D232 Patent has been and continues to be
8 willful and deliberate.
9 48. In violation of 35 U.S.C. § 271, Getac has infringed and continues to
10 infringe the ’D232 Patent by using, offering for sale, selling, and/or importing into the
11 United States at least GETAC K120 identified in this Complaint, which employs the
12 design covered by the ’D232 design patent.
13 COUNT II: INFRINGEMENT OF THE ’D994 PATENT
14 49. Panasonic alleges and incorporates by reference the allegations set forth
15 in paragraphs 1- 48.
16 50. As shown by the side-by-side comparison below, Getac has
17 misappropriated Panasonic’s patented portable computer design in the accused

12 Getac has infringed, and will continue to infringe unless enjoined, the ’D994 Patent.
13 55. Getac’s infringement of the ’D994 Patent has been and continues to be
14 willful and deliberate.
15 56. In violation of 35 U.S.C. § 271, Getac has infringed and continues to
16 infringe the ’D994 Patent by using, offering for sale, selling, and/or importing into the
17 United States at least GETAC K120 identified in this Complaint, which employs the
18 design covered by the ’D994 design patent.
19 COUNT III: INFRINGEMENT OF THE ’D998 PATENT
20 57. Panasonic alleges and incorporates by reference the allegations set forth
21 in paragraphs 1-56.

1 71. Getac’s infringement of the ’D634 Patent has been and continues to be
2 willful and deliberate.
3 72. In violation of 35 U.S.C. § 271, Getac has infringed and continues to
4 infringe the ’D634 Patent by using, offering for sale, selling, and/or importing into the
5 United States at least GETAC K120 identified in this Complaint, which employs the
6 design covered by the ’D634 design patent.
7 PRAYER FOR RELIEF
8 WHEREFORE, Panasonic prays for relief as follows:
9 a. A judgment that Getac has infringed the ’D232 Patent, the ’D994 Patent,
10 the ’D998 Patent, and the ’D634 Patent;
11 b. A judgment declaring Getac’s infringement of the ’D232 Patent, the
12 ’D994 Patent, the ’D998 Patent, and the ’D634 Patent willful and deliberate;
13 c. A finding that Panasonic has no adequate remedy at law and an order and
14 judgment permanently enjoining Getac, its parent companies, subsidiaries, related
15 companies, and all persons acting in concert or participation with Getac, or persons
16 acting or purporting to act on its behalf, including, but not limited to its officers,
17 directors, partners, owners, agents, representatives, employees, attorneys, successors,
18 and assigns, and any and all persons acting in concert or privity with them, from
19 making, using, importing, exporting, distributing, supplying, selling or offering to sell,
20 or causing to be sold any product falling within the scope of the ’D232 Patent, the
21 ’D994 Patent, the ’D998 Patent and the ’D634 Patent, or otherwise contributing to or
22 inducing the infringement of the ’D232 Patent, the ’D994 Patent, the ’D998 Patent and
23 the ’D634 Patent;
24 d. A judgment awarding Panasonic all damages adequate to compensate for
25 Getac’s infringement of the ’D232 Patent, the ’D994 Patent, the ’D998 Patent, and
26 the ’D634 Patent, including all pre-judgment and post-judgment interest at the
27 maximum rate permitted by law, as well as its costs and disbursements;

navigated with Multiple Touch Modes ranging from Regular Touch, Glove and Pen modes, and an optional Digitizer mode,

The tablet’s battery is engineered for full-shift productivity, allowing users to customize settings and modules to fit their needs
on the field. An optional High Capacity Battery can also be implemented to double the system’s runtime for maximized
productivity. Hot-swapping technology is also utilized for quick and secure battery replacement without the need to power
down. All battery packs fit into their compartments without the need of additional covers and are firmly secured by a double-

that delivers all the advantages of a fully functioning laptop and tablet.”
Because mobile workers are charged with completing increasingly complex tasks in the field,
the Toughbook 20 features the power required to get the job done, including a 6th Generation
Intel® CoreTM vProTM processor technology, 128GB SSD, 8GB RAM and choice of Windows
10 Pro or Windows 7 Professional (available through downgrade rights from Windows 10 Pro).
An extremely flexible solution, the Panasonic Toughbook 20 offers six usage modes, making it
ideal for any situation or environment. Besides being used as a traditional laptop, tablet can
be detached and used by itself or flipped 180-degrees to show content in presentation mode.
The convertible mode allows users to see the display with the keyboard attached and ready
when it is needed. Using the built-in handle, the device can operate in carry mode or hanging
on a wall, while vehicle mode provides full functionality and operation of the device when on
the move.
Continuing to set the standard for ruggedness and reliability, the Toughbook 20 is designed to
meet MIL-STD-461F for electromagentic interference and MIL-STD-810G for drop, shock,
vibration, explosive atmosphere, temperature, humidity, rain and sand, as well as waterproof
and dustproof ingress (IP65). The device features a magnesium alloy case, fanless design,
locking port covers, raised bezel, Solid State Drive (SSD) heater and a built-in handle for ease
of use, which also serves as a kickstand for desktop stability and enables use while hung.
“While relatively easy to design from a consumer perspective, the stresses a detachable
laptop will endure in the environments in which our customers operate created serious design
challenges. A significant amount of engineering went into this device to ensure it would deliver
the reliability the Toughbook brand is known for,” continued Ruderman.
The fully rugged detachable laptop is purpose-built for mobile workers, delivering features that
enable productivity both in and out of doors, including a 10.1” sunlight-viewable 800 nit IPS
display with gloved multi touch capabilities, a waterproof stylus pen and a backlit keyboard
that is 16 percent larger than the Toughbook® 19. The standard 2MP webcam and optional
8MP rear camera expand communications options for field workers. The device’s optional
bridge battery allows for continuous operation and the optional second battery (located in
keyboard dock) doubles battery life and can also be swapped between the tablet and

Windows devices and 6th Generation IntelżR CoreTM vProTM processor technology, plus
integrated options such as insertable or contactless SmartCard readers, fingerprint readers for
maximum flexibility for dual factor authentication. The device also includes dual Kensington
lock slots - one that secures the tablet and the keyboard and a second for the keyboard dock
only.

Now let's look at the tech specs. Here, the K120 excels at the
processor front, offering a powerful choice of all-quad-core CPUs from
Intel's 8th generation of Core processors. No more lower-end
processor options that can still run Windows 7. The K120 is all
Windows 10, looking into the future and not the past. The table below
shows processor specs. These chips are relatively close together, all
high-performance, and so the choice may come down to whether or
not a customer needs Intel's vPro technology for enhanced security
and remote management.

The K120 display is of the IPS variety, which means it has virtually
perfect viewing angles from all directions. Its 12.5-inch size and 1920 x
1080 pixel full-HD resolution match Xplore's R12 tablet, and its 1200
nits luminance matches the Panasonic Toughbook 33 (but not the
Toughbook's higher 2160 x 1440 resolution). There's, of course, 10-
point capacitive multi-touch, a hard tip stylus, and an optional active
digitizer.
Used as a tablet, the Getac K120 offers very adequate I/O. USB 3.0
and Type-C 3.1 are there, as are a LAN jack, HDMI, audio and optional
antenna pass-throughs. Use in conjunction with the detachable
keyboard adds plenty more: another three USB 3.0 ports, another LAN
jack, another HDMI port, and also serial and VGA.
The Getac K120 is billed as a fully rugged device. That includes IP65
sealing (dustproof, and immune to low pressure water jets from all
directions) and a very wide operating temperature range of -20 to 145
degrees Fahrenheit, and the claim to be "certified to MIL-STD 810G."
We'd like to see more specifics in the specs. Most customers probably
would, too.
With the new K120, Getac now has a direct competitor to Panasonic's
Toughbook 33, and one that beats the Toughbook on the processor
front. That was needed, and also further expands Getac's increasingly
complete lineup of rugged computers for most conceivable applications
