ON PETITION FOR WRIT OF INJUNCTION

ORDERED:

1. Relator’s motion for emergency relief, filed June 21, 2019, is granted. All
proceedings in Cause No. D-1-GN-18-006433, styled Max Grossman v. Mark Wolfe,
Executive Director, Texas Historical Commission, in the 261st District Court of Travis
County, Texas, are stayed pending further order of this Court.
2. Mark Wolfe, Executive Director of the Texas Historical Commission shall
place Permit Number 8525, concerning the Proposed El Paso Multipurpose Performing
Arts Center in El Paso County, Texas, issued on or about October 15, 2018, in
suspension.
3. Mark Wolfe shall notify immediately the City of El Paso that the
archeological survey may not commence, including the demolition of any buildings
within the footprint of the project (as defined by the Rule 11 agreement entered on
October 25, 2018) or any asbestos remediation of those same buildings, until further
order of the Court.
4. The City of El Paso may not demolish any buildings within the footprint
of the project (as defined by the Rule 11 agreement entered on October 25, 2018) until
further order of the Court.
5. The real parties in interest are requested to respond to relator’s petition for
writ of injunction on or before July 2, 2019.
6. The petition for writ of injunction remains pending before this Court.
