RESOLUTION NO. 2019-___

A RESOLUTION CALLING ON DECA HOMES TO STOP THEIR DEVELOPMENT WORKS

UNTIL THEY HAD PRESENTED TO US THEIR ACCEPTABLE FLOOD CONTROL MEASURES

WHEREAS, the rainy season is fast approaching, and so is the probability that a good portion of this
Barangay will be inundated due to the accumulation of rainwater which could not freely flow to the
Buntatala Creek which is the floodwater’s natural exit;

WHEREAS, the proximate cause of this peril facing the constituents of this Barangay, particularly the
residents of San Vicente Village Subdivision is the development works being implemented by DECA Homes
on the lower portion of this Barangay, which would effectively impede the natural downward flow of
floodwaters;

WHEREAS, the law provides that:

Article 50. Lower estates are obliged to receive the waters which naturally and without
the intervention of man flow from the higher estate, as well as the stone or earth which
they carry with them.

The owner of the lower estate cannot construct works which will impede this natural flow,
unless he provides an alternative method of drainage; neither can the owner of the higher
estate make works which will increase this natural flow. (PRESIDENTIAL DECREE No.
1067 December 31, 1976)

WHEREAS, in various fora and through oral and written communications, this matter has been timely
brought to the attention of DECA Homes, the Local Government of Leganes, and other national
government agencies, BUT IN SPITE OF THESE, the constructions works continue unabated, without
showing any development, actual or on paper, that would allay the apprehension and fear of the affected
residents of this Barangay;
NOW THEREFORE, on motion by Hon. Stephene L. Apud and duly seconded by ____________ :

BE IT RESOLVED, AS IT IS HEREBY RESOLVED to call on Deca Homes to stop their

development works until they had presented to us their acceptable flood control
measures;

RESOLVED FURTHER that copies of this Resolution be furnished the Honorable Municipal
Mayor Atty. Jose Romi Marañon and the Honorable Sangguniang Bayan for their
information and appropriate action.

explain our stand on the DECA project... They agreed and to pass a resolution for DECA to stop their
development works until they had presented to us their acceptable flood control measures.. They request
