10 of the old Civil Code
(Article 16, new Civil Code)
provides that the validity of
testamentary dispositions
are to be governed by the
national law of the person
whose succession is in
question. In case at bar, the
testator was a citizen of the
State of Nevada. Since the
laws of said state allow the
testator to dispose of all his
property according to his
will, his testamentary
dispositions depriving his
wife and children of what
should be their legitimes
under the laws of the
